BOARD OF SUPERVISORS MEETING

Monday, November 11, 2013                                               7:00 p.m.                                                               Town Hall

The November 2013 Board of Supervisor’s meeting was called to order at 7:08 p.m.

Today is Veteran’s Day and we would like to take this moment to remember
all who sacrificed their lives in the past, present and future to
achieve peace and democracy.

Officials present:  Chairman Dan Knutzen, 1st Supervisor Dan Rettler, 2nd Supervisor Tom Neubert,
Clerk Karen Herman, and Treasurer Jeri Ohman.  Wilfred & Jeanette Theobald were present from
7:00 p.m. – 7:21 p.m. to discuss land issues.  Brian Gruendemann was present to discuss road issues.  Michael & Brenda Garvey were present observing the board meeting.

The agenda was posted according to the open meeting law on November 7, 2013. 
MOTION:  Neubert/Rettler to approve the November 11, 2013 monthly town board meeting agenda as presented.  All said aye.  Motion carried.

MOTION:  Rettler/Neubert to dispense the reading and approve the October 14, 2013 town board meeting minutes with the correction under roads ‘8 loads of gavel were needed to fill the holes on “Wolf” Rd’.  All said aye.  Motion carried. 

MOTION:  Rettler/Neubert to approve working on the budget meeting minutes of November 23, 2013.  All said aye.  Motion carried.

MOTION:  Neubert/Rettler to approve the minutes from the Budget Hearing and the Electors meeting to approve the 2013 tax Levy to be paid in 2014.  All said aye.  Motion carried.

a.)  Sheriff Department– No one present.

b.)  Wilfred Theobald requesting a written recommendation for dirt to be placed in section 7 plotted by
      FSA office MOTION:  Rettler/Neubert to accept Wilfred’s letter of completion.  All said aye.  Motion
      carried.  The Town Board and Clerk signed the approved letter which follows: 

               This project is being worked at the southwest corner of SEC7 (platted out of Gov Lot
      7 SEC7-23-17).

              The Town of Black Creek has cleaned and lowered the road ditch on the south side of
      Genske Road to meet the bottom of the culvert that crosses Genske Road.  The water moves
      from the south side road ditch through the culvert to the north side road ditch and then
      proceeds north through a drainage ditch that takes it straight north to the Black Creek.

          The town cleaned the ditch out abont 110’ east of the culvert and about 150’ west of the
     culvert on the south side of Genske Road.  The spoils were piled up on the south edge of the

     field next to the road ditch out of the wetland marking.  This is all done in the south west
     corner of SEC7.  The town had planned to clean and lower the ditch for the last two years
     because the water has been flooding in the south ditch and running over the road to the north
     ditch.  This project has been completed within the last week of October 2013.

               The Town Board of Black Creek has completed this plan for this project and approves this
     document.

c.)  Town HallFire Department has not installed the lock box at the Town Hall as of yet.

d.)  Roads
      Pavement Ratings due 12/2013– We received the bill from Outagamie County for doing the pavement
      ratings but a copy of the pavement rating sheets were not received yet.

      culvert.
      Wilfred Theobald clean out Genske Rd ditchCompleted.  Take off agenda.

      A rate sheet will be submitted by Brian Gruendemann for snow plowing.

MOTION:  Rettler/Neubert to adopt the 2014 budget.  All said aye.  Motion carried. 

j.) Approve the agreement for backup assistance by and between the Town/Village of Black Creek,
     Town/City of Seymour, and the Town of Osborn Fire Departments
MOTION:  Rettler/Neubert to
     approve the agreement for backup assistance by and between the Town/Village of Black Creek,
     Town/City of Seymour, and the Town of Osborn Fire Departments.  All said aye.  Motion carried.

k.)  Ambulance 2014 contract– Knutzen has this document but did not bring to the meeting tonight.

l.)  BOR Appeal to Wis. Supreme Court – Frank Sausen – No Wisconsin Supreme Court decision has been
     made as of yet.

m.)  Certified Survey Map (CSM) approvals/Review Preliminary Reports—Wickesberg 010013400

Tabled until the next Town Board meeting.

n.)  Reserve Liquor License $10,000 payback fee application – 14K Bar – 14KBar’s attorney will notify us
      as to when they would like to receive the license.

o.)  Approve Tax Bill Special Charges for Waste Pickup and Fuel Surcharges

      MOTION:  Neubert/Rettler to approve $116.83 for 2014’s garbage collection to be placed on the tax
      bill.  All said aye.  Motion carried
.  The rate of $116.83 includes an anticipated 3% increase from
      2013’s yearly fee per stop plus fuel surcharges from Sept. 2012 – Sept. 2013. 

      MOTION:  Neubert/Rettler to approve the yearly number of collection stops for 2014’s garbage
      /recycling billing starting January 2014 which will be 476 stops.  All said aye.  Motion carried
.
      Harter’s will bill the town for 476 stops monthly.  Once the number of stops increases to 10, the town
      will notify Harters and the agreement will be reviewed. 

      We will bill recycling to Outagamie County for 476 stops starting January 2014 for the entire year.  In
      the past, the total number of stops were reviewed and changed monthly. Since the numbers do not
      fluctuate often, this procedure will be less confusing for all.

      The Town of Black Creek and Outagamie County have a Scope of Service Agreement that originated in 
      1992 which the Town Board was aware of when renewing the 2013 contract with Harters Fox Valley
      Disposal.  This agreement states that the County requires any Municipality that contracts directly with a
      third-party entity to be reimbursed at the Municipality’s lowest third-party quote and if a Municipality
      chooses to extend contracts without going through a formal bidding process is in violation of the Scope
      of Service Agreement.  The Clerk reminded the board that since the town board chose not to go out for
      bid with the 2013 recycling contract, Outagamie County will refund the town no higher than Inland’s
      fuel surcharge rates and Inland’s monthly collection rate starting January 2014 for the duration of the
      contract.  The Town of Black Creek’s 2014 anticipated recycling rate with Harter’s will be $2.52 per
      stop/per month and Inland’s rate with Outagamie County for 2014 will be $2.71 per stop/per month. 
      The town will be refunded with the lesser of the monthly rates and the fuel surcharge rates will be
      refunded according to Inland’s calculations. 

p.)  Approve 2014 Election Hardware Maintenance Agreement MOTION:  Rettler/Nubert to approve
      the 2014 Hardware Maintenance Agreement with Command Central.  All said aye.  Motion carried.

q.)  Approve the 2014 Fee Schedule
      MOTION:  Neubert/Rettler to approve the January 2014 Fee Schedule with the addition of “plus
      shipping and handling” for addressing numbers.  All said aye.  Motion carried.
 
    
r.)  Set Annual Meeting date for 2014 – Wednesday, April 16, 2014 will be the Annual Meeting in 2014.
 

Next month’s board meeting will be scheduled for Wednesday, December 11, 2013 at 7:00 p.m. due to conflict in schedules.

Correspondence taken care of.

The treasurer's report, receipts, disbursements, checking, and money market accounts for totals have been reviewed.

MOTION:  Neubert/Rettler to accept the Treasurer’s Report, approve and pay the bills and to transfer $37,500.00.  All said aye.  Motion carried.
