Public Zoning Hearing Minutes

 

Monday, February 16, 2015                                  8:00 p.m.                                              Town Hall

The Public Hearing was called to order at 8:02 p.m. 

 

Matt Wilcox and Megan Mulholland, N6484 12 Corners Rd, Town of Black Creek, has requested that parcel no. 010-029101, section 15, 38.30 acres, currently zoned exclusive agriculture, are requesting for the property to be rezoned to general agriculture with a split.  The residence would reside with 5.914 acres and the remaining 32.386 acres would be a separate parcel.

The following were present at the hearing:
Planning Commission:  Dan Knutzen (Chairman), Norman Steffens, William West,
Michael Garvey, and Lee Lemke. Clerk Karen Herman was present. 
Board members:  Tom Neubert, and Dan Rettler.  Guests:  Dave Johnson, Assistant Planning Director with Outagamie County and Jeffrey Sanders with Community Planning and Consulting LLC.  Residents:  Megan Wilcox, Fritz Piete, and Deb Deschler.  Everyone signed in.

The agenda was posted according to the open meeting law in the ACN/Times Press Newspaper (Seymour) for 2-weeks, February 2 and February 9, 2015.  The agenda was also posted January 30, 2015 at the 3-posting places, the front door of the town hall building, and town’s web site.

        

Introductions were made.

-Megan Wilcox explained that they have been unsuccessful for approximately 5 years with selling their house.  The rezone will allow them to sell their home and sell the remaining acres to the neighbor.
 

-Deb Deschler asked if this land division and rezone would set a president for future rezones.  Jeff Sanders responded that each situation is decided individually, case by case for rezones.

 

Jeff Sanders explained that is un-farmable and undevelopable land currently zoned exclusive agriculture.

 

Letters were sent to local lands owners regarding this hearing.  Fritz Piete was the only one who responded.  Piete’s plan is to purchase the land adjoining to his property to use for hunting and recreational land.  He has no intention to build on the property.

 

With no more questions.

Planning Commission Meeting

(Immediately Following the Close of the Wilcox Public Hearing)

Monday, February 16, 2015                                 8:13 p.m.                                              Town Hall

 

The Planning Commission meeting was opened at 8:13 p.m.
Planning Commission present:  Dan Knutzen (Chairman), Norman Steffens, William West, Michael Garvey, and Lee Lemke. Clerk Karen Herman was present.  Board members:  Tom Neubert, and Dan Rettler.  Guests:  Dave Johnson, Assistant Planning Director with Outagamie County and Jeffrey Sanders with Community Planning and Consulting LLC.  Residents:  Megan Wilcox, Fritz Piete, and Deb Deschler (left at 8:14 p.m.). 

 

MOTION:  Garvey/West to recommend that the Town Board accept the CSM as a split and a rezone from Exclusive Agriculture to General Agriculture on Lot 1 and Lot 2.  All said aye.  Motion carried.

MOTION:  West/Steffens to close the Planning Commission meeting at 8:15 p.m. all said aye.  Motion carried.
