Monthly Town Board Meeting Minutes

BOARD OF SUPERVISORS MEETING

   

Monday, April 13, 2015                                      7:00 p.m.                                            Town Hall


The Board of Supervisor’s meeting was called to order at 7:02 p.m. 

Officials present:  Chairman Dan Knutzen, 1stSupervisor Dan Rettler, 2ndSupervisor Tom Neubert, Treasurer Jeri Ohman (left at 7:50 p.m. after Treasurer agenda items were discussed), and Clerk Karen Herman. 

Others present:  Deputy Sheriff Trevor Quella was present (left at 7:09 p.m. after town issues were discussed); Resident Michael Garvey was observing the Town Board meeting (left 9:46 p.m.); and Resident Brian Grundemann was available to discuss the town road repair issues (left at 10:08 p.m.).

The agenda was posted according to the open meeting law on April 9, 2015. 

MOTION:  Rettler/Neubert to accept the March 9, 2015 Town Board Meeting Minutes as presented.  All said aye.  Motion carried.  Minutes were not read.
 

Building Permits:         
Building Permit #4 – Mike Bissing – Grain Bin with no electric

                               

a.)  Sheriff Department– Deputy Sheriff Trevor Quella was available to discuss town issues.      

b.) Mon., May 11, 2015 Monthly Town Board Meeting Changed to Thurs., May 14, 2015; Set Date to Audit
     Books in May
– 5/14/15 6:45 p.m. Auditing Books 

c.)  Treasurer’s Old LaptopTreasurer kept anti-virus on both computers until everything is transferred over to
       her new computer.  Discussion took place with what to do with her old computer. 

d.)  Treasurer’s Report on receipts, disbursements, checking, and money market accounts for totals from the
       previous month

       –Last month, $1,100.45 NSF fee reversed so the money will be deposited into checking and withdrawn
         from money market account.  NSF needs to be withdrawn from the Money Market Account.
 
       –$20.80 endorsement stamper fee will be refunded into the checking account next month. 
       –Money Market deposit of $3,601.41 was deposited into the checking account and will be reversed next
         month. 

e.)  Clerk Presents Bills and Transfers Money to Pay BillsMOTION:  Neubert/Rettler to accept the Treasurer’s
       report, approve the bills, and transfer $60,000.00 to pay the bills.  All said aye.  Motion carried.    

       WTA—5/6 Town Official Workshop – Attending:  Rettler, Knutzen, and Herman

f.)   2015-2016 Beer/Liquor Licensing
Licensing paperwork for 2015-2016 distributed to Romy’s Nitingale and
       the Black Creek Sportsman’s Club. 

g.)  Tire and Scrap Metal Collection Day:  April 18, 2015Neubert setting up.  Clerk needs updated
      Certificate of Insurance. 

h.)  Town Hall

      Board Room CabinetsTabled until the next board meeting.   

      Concrete Filled in at Front DoorTabled until the next board meeting. 

      Projector Pull Down ScreenRettler and Neubert installed.  Projector screen is working good.        

i.)  Roads–Status of Culvert on Krueger Rd in Front of Norman Steffen’s Home—Field Tile is Lower than the
      Culvert
– Board will be checking into this situation. 

      Cleaning Cross Rd Culvert South of Mike Bissing home on 12 Corners RdDitches are filled up on both
      ends of culvert.  Culvert looks good.  Checking with Darrin Stingle to clean out.  Clerk needs Certificate of
      Insurance. 

Ballard/Culbertson Rd culvert by Floyd Keiffer home – 32 ft. culvert est. $3,823 with Brian Gruendemann—Radtke Contractors Inc. on West end of dead end road.  Price list with time and material presented. 

South end of Ballard Rd – on top of hill the road is buckling up.  This would be a major fix with possibly patching when dry.
      Set Date to Take Down Limit Signs on Town RoadsClerk will be posting that the weight limit signs will be
      taken off the town roads on 4/23 through 4/24/15 8:00 a.m. until completion. 

      Ditch Repair on 12 Corners Rd from Accident – $750 for repairs– Knutzen did not give the accident road
      report to the Clerk for billing. 

      Kropp Rd & Krueger Rd Pot Holes– 10 feet east of the Dale Schmoll’s property there is a large dip on
      Kropp Rd.  Knutzen said this is a continuous problem so take off the agenda and place on the agenda as
      pot holes town roads.     

      Purchase New Style of Road Sign Posts vs Old Style– Neubert suggested to purchase posts this year and
      signage next year.  Checking with WTA if town is responsible for purchasing names signs for County Rd
      PP, Hwy 47, and Hwy 54.  Determining how many posts need to be purchased.  Twelve feet stop signs
      posts and square 4×4 posts. 

      Culvert Fallen in – Schimmelpfenning Rd Off of County Rd PP by First Home– Fixing once area has dried
      up for repairs. 

j.)  Planning Commission – Creation of Base Farm Tract MapMichael Garvey mentioned that Bill West
      brought up items for discussion at the last meeting with regards to updating the Town and Village
      Comprehensive plan and was told that the meeting was a briefing with no discussion and changes.  The
      Planning Commission is coming prepared to the monthly Comprehensive Plan Update Meetings and are
      ready for discussions but are being told that the current contract with Community Planning and
      Consulting LLC are for general comprehensive plan changes and that additional money may need to
      be allocated for more in depth changes to the comprehensive plan.  A Town Planning Commission
      meeting may need to be setup. 

       Next Joint Planning meeting with Village of Black Creek will be 4/27/15 at 6 p.m. at the Village
       Community Center lower level. 

      Official Zoning Map needed according to approved Ordinance #01-2015Ordinance 01-2015 and New
      Zoning Ordinance has been posted on our town website and also it is available at the Village Public
      Library for review.  The Clerk updated the board that according to Ordinance 01-2015 an official zoning
      map needs to be posted as well.  Clerk needs the official zoning map. 

      The Clerk has updated the Zoning buy brand effexor xr Parcel List and has distributed the 2 packets to the Town Board last
      month.  The list is categorized by parcel and last name.

     Clerk reviewed all run collection information from attorney.

     MOTION:  Knutzen/Neubert to take the judgments off the agenda and leave the other 4 on the agenda.
     All said aye.  Motion carried.  Keep Plaster, Schulz, Vanderwegen, and Keller on the agenda.  The other
     runs have judgments so no further action will be pursued at this time.      
          
      Town Ordinanceneeded for Fire Dept. to bill insurance companies for runs
      At the 5/6 fire meeting this subject will be brought up to the fire committee and have the Village and
      Town approve.

m.)  Eric Ostrenga Requesting to Split off Farmland from House 28.1 AC Parcel #010 001500

       Resident would like to split and sell all his property which includes a farmstead and open acreage on
       Adolph Road.  The trail cuts through his property.  Take off agenda.


n.)   County Preliminary Reports or Certified Survey Map (CSM) approvals—
        CSM Ronald & Tammy Volkman 010 068200MOTION:  Neubert/Rettler to accept the CSM for Ronald
        Volkman.  All said aye.  Motion carried.  Exclusive Agriculture zoned property–5.957 AC House and
        36.866 AC farmland.

        Preliminary-Daniel & Angela Ott 010 012100 and 010 011902–Financing home and needs to be split
        from total acreage.  Total acreage 60 AC.  Split home off in a 5 AC parcel. 

o.) Budget Resolution 04-2015
       BUDGET ACCOUNT

       The sum of $73.00 from the Fuel Surcharge/Land Fill Charges budgeted account be transferred to the
        budgeted category Dues to pay the bills.

p.)   Ryan Rohan—Hwy 54 Recycling Compliance Letter– Letter from attorney will be sent. 

Subdivision Abandonment – Lawyer looking into. 

q.)  Town Assessor, Borree Services, Inc. – 2015 revaluation addendum contract agreement for consulting,
       assessing and appraisal services
MOTION:  Knutzen/Rettler to accept and pay bill for Borree for
       revaluation services.  All said aye.  Motion carried.
 

r.)   Set Dates for Open Book and Board of Review– Adjourn Board of Review on 6/8/15 at 6:45 p.m.

      Appoint Board of Review Alternates and Approve Confidentiality formMOTION:  Neubert/Rettler to
      accept the alternates.  All said aye.  Motion carried.  The alternates are:  William West, Brian
      Gruendemann, Michael Garvey, Bev Neubert, and Jeri Ohman. 

      MOTION:  Neubert/Rettler to accept the confidentiality of income and expense records from $25 to $200. 
      All said aye.  Motion carried

s.)   Invite to Attend Bill West’s Meeting on 4/10/15 from 9:30 a.m. – Noon with DOT– DNR & DOT was there
       with a lot of discussion. 

t.)  Skinkis Lawn & Landscape LLC – Town Hall Lawn Maintenance Agreement– Motion:  Rettler/Neubert to
      accept the 2015 $85 per occurrence contract with $3.50 for plant bed.  All said aye.  Motion carried
      Clerk needs Skinkis updated Certificate of Insurance.

u.)   Annual Meeting 4/22/15 at 8:00 p.m.– 4-H taking care of lunch.  Rettler taking care of beer and soda.
       Agenda items discussed.  Representative Steineke, Steve Swanson with County Zoning, and Christine
       Miller with Outagamie County Recycling will be our guest speakers for the Annual Meeting. 

       Rettler will be looking into the front entrance lock problem. 

v.)   April 7, 2015 General Election Results; April 10, 2015 Municipal Board of Canvassers Reconvene– Total
       Voters = 232; Edge machine = 207; Paper = 25.  There was 3 outstanding ballots so the Municipal Board
       of Canvassers reconvened on Friday, April 10, 2015 to count the 3 ballots. 

w.)   Pond Permit/Ordinance with Town Regulations– The Town Board is trying to determine if they should
        continue to give out pond permits.  The Town Board wanted to know if there is an assessment value for
        ponds.  The Clerk checked with Justin, Borree Services (town assessor) to determine if there is an
        assessment for ponds.  Clerk presented the response to the board.  Ponds have no major influence with
        value of the property but also how it can be an attractive nuisance and board permits can be beneficial. 
        Board will be checking with Steve Swanson, County Zoning Department.  Tabled until we get more
        information.

x.)
   Review and Adjust the 2015 Town of Black Creek Fee ScheduleTabled until the pond permit issue is
       resolved. 

y.)   Assessment Ordinance #02-2015 to Allow Phone Calls Instead of Appearing before the Board of
        Review– 
MOTION:  Neubert/Rettler to approve Ordinance #02-2015.  All said aye.  Motion carried.

z.)   Annual Report Approval
       MOTION:  Neubert/Rettler to approve the 2015 annual report.  All said aye.  Motion carried.

 

Annual Highway Municipal Meeting – 4/27/15 3:30 p.m. Knutzen checking into meeting times available.

Scott Construction Meeting – 4/16/15 3:00 p.m.

 

Fire Chief Dwight LaMarche needs a list of business residing within the Town of Black Creek for 2% fire dues.
Clerk reviewed list with the Town Board. 

The Black Creek Fire Department is being audited for their fire run reporting which may affect the 2% Fire Dues from the State.

Correspondence taken care of.
 

Total bills for April:  Fox Communities = $60,074.40
