PETITION FOR DISCONTINUANCE OF AN UNPAVED ALLEY WITHIN THE MAPLE CREST SUBDIVISION

 

Tuesday, June 30, 2015                       7:00 p.m.                             Town Hall

 

The Town of Black Creek Town Board held a public hearing on Tuesday, June 30, 2015 at 7:00 p.m. at the Black Creek Town Hall located at N6051 Twelve Corners Road. 
 

Daniel R. and Elizabeth A. Hermus, owner of Lot 29 parcel #010-083700 and Lot 30 parcel #010-083800 in the Maple Crest Subdivision has made a petition to the Town of Black Creek requesting that the “unpaved alley”, Wis. Stat. § 236.02(1), between Lots 29 and 30 be discontinued.  Pursuant to Wis. Stat. § 66.1003(3) the Town Board may discontinue all or part of the unpaved alley.

 

The posting for this hearing was done in the ACN/Times-Press on June 8, 15, and 22, 2015; at the town’s three posting places and the town’s website.

 

Registered letters regarding the hearing were sent to the following: 
Daniel & Elizabeth Hermus, Dennis & Rosanne Roskom (LE), Seymour Community Schools JT, Elton & Janet Check, and Peter & Brenda Kempen.  Copies were sent to David J. Van Lieshout, Law Office.

 

The floor was opened for anyone to speak.  Discussion took place. 

There were no objections.

The Hermus Attorney will be taking care of reinverting the alley to the Hermus property.

 

MOTION:  Rettler/Neubert to close the hearing at 7:08 p.m.  All said aye.  Motion carried.

Special Town Board Meeting

PETITION FOR DISCONTINUANCE OF AN UNPAVED ALLEY WITHIN THE MAPLE CREST SUBDIVISION

 

Tuesday, June 30, 2015                       7:09 p.m.                             Town Hall

 

Immediately following the Public Hearing, the Town Board opened a special Town Board Meeting at 7:09 p.m. to approve or deny the petition request for discontinuance of an unpaved alley within the Maple Crest Subdivision.

Everyone remained seated after the public hearing. 
 

The posting for this special town board hearing was done at the town’s 3-posting places, and the town’s website on June 26, 2015.

 

MOTION:  Rettler/Neubert eliminate the Road and attach it to Lots 29 & 30.  All said aye.  Motion carried.

 

MOTION:  Rettler/Neubert to adjourn at 7:11 p.m.
