Monthly Town Board Meeting Minutes

TOWN OF BLACK CREEK
MONTHLY BOARD OF SUPERVISORS MEETING   

Monday, August 10, 2015                                      7:00 p.m.                                            Town Hall

The Board of Supervisor’s meeting was called to order at 7:02 p.m.
Officials present:  Chairman Dan Knutzen, 1st Supervisor Dan Rettler, 2nd Supervisor Tom Neubert, Treasurer
Jeri Ohman (left after Treasurer’s agenda items were discussed 7:36 p.m.), and Clerk Karen Herman.   

The agenda was posted according to the open meeting law on August 5, 2015. 

MOTION:  Rettler/Neubert to accept the July 13, 2015 Town Board Meeting Minutes.  All said aye.  Motion carried.  Minutes were not read.

Building Permits:         
  #9 – Peter Miles — 2 Storage Sheds with Electric

#10 – David Calnin – Addition to House with Electric

#11 — Jim Brown — Addition to House with Electric
                               

a.)  Sheriff Department– No one present.      

b.) County Preliminary Reports or Certified Survey Map (CSM) approvals:  Reapprove CSM Clarence & Susan
       Witterholt 010-043000 (originally approved 9/8/14) –
MOTION:  Rettler/Neubert to accept the CSM for
       Whitterholt.  All said aye.  Motion carried.  Clerk was contacted by Tom McClone, surveyor for the
       Witterholt’s property, regarding the town board reapproving last year’s CSM.  There are some bearing
       issues which needed to be adjusted before the county would approve.  Dave Johnson with Outagamie
       County Planning emailed a letter explaining the corrected CSM issues.

C.)  Treasurer’s Report on receipts, disbursements, checking, and money market accounts for totals from the
       previous month

d.)  Budget Resolution 07-2015

      BUDGET ACCOUNT
        The sum of $745 from the Election budgeted account be transferred to the budgeted category
        Attorney/Legalto pay the bills.  Roll call vote:  Rettler-YES; Neubert-YES; Knutzen-Yes
        3=YES; 0=NO     Passed  

e.)  Clerk Presents Bills and Transfers Money to Pay BillsMOTION:  Rettler/Neubert to accept the Treasurer’s
       report, approve the bills, and transfer $48,300.00 to pay the bills.  All said aye.  Motion carried.    

Treasurer will be sending a letter to Thomas and Debra Krsnich regarding cashing their $25 tax credit from the beginning of 2015. 

There was a request that the September 14, 2015 monthly Town Board meeting be changed to Wednesday, September 16 or Thursday, September 17.  Clerk will notify the Town Board and Treasurer with the decided date at a later time. 

f.)   Mike & Cindy Koller Division of Land to Build Home 010-029302Knutzen has not contacted the Kollers as
      of yet. 

g.)  Set Date to Audit Books 9/14/2015 at 6:45 p.m.— Next month’s monthly Town Board meeting date has
       not been set yet.  Once the date is determined, the Clerk should schedule the audit to start 15 minutes
       prior to the Town Board meeting start time. 

h.)  Appoint 3-year term:  Board of Appeals Members Brian Gruendemann and Darrin Stingle
       MOTION:  Rettler/Neubert to reappoint Brian Gruendemann and Darrin Stingle for another 3-year term.
       All said aye.  Motion carried.  

i.)  Town Hall –Board Room CabinetsTabled until the next board meeting. 
       Repair Air Conditioning UnitKnutzen will be contacting Bob Boucher to look over the Town’s cooling
      system.  Clerk informed the board that we will need Bob’s Certificate of Insurance.
      
New Storage ShedThe board will be looking into building a pavilion and new storage shed here at the
      Town Hall.  Knutzen will be researching and bringing back the information for next month’s meeting.        

j.)  Roads–
      Ballard/Culbertson Rd Culvert – install new culvert with Radtke Contractors Inc.
Knutzen reported that
      Brian Gruendemann, with E & G Restoration, will be renting the equipment to take care of this situation. 

      Culvert Fallen in – Schimmelpfenning Rd Off of County Rd PP by first homeKnutzen reported that
      Brian Gruendemann, with E & G Restoration, will be renting the equipment to take care of this situation.

      Kropp Rd – Gravel on the shoulder by the road curves – Knutzen will have Brian Gruendemann look into
      this situation.  Tabled until the next meeting. 

      Scott Marcks Trucking – Ott, Mullen, and Wolf Rd GradingWork completed.

      W4820 Krueger Rd – Trees Trimmed in Right of Way – Knutzen will be contacting Brian Gruendemann to
      look into this situation which is located by Lee Lemke’s home. 

      Pot Holes on Town Roads – Ballard and Wood Roads will be looked into. 

      Purchasing Town road Name Signs and Posts – Lange–Waukesha, WI will hold the price for 1 more month. 
      Planning on purchasing for ½ of the Town.  Cost will be $2,908.50.  Neubert will be checking the shipping
      costs and compiling the road name sign list.

       Scott Construction, Inc. Projects –Seal Coat Forest Rd – Seal coating not done yet.  Possibly completing in
       2-weeks.  Tabled until the next board meeting. 

Crack Filling http://www.health-canada-pharmacy.com completed on 8/7 or 8/8/15 for Forest Rd, Black Friar, and Stingle Rd.     

k.)  Planning Commission – Creation of Base Farm Tract MapTabled until the next board meeting.

      Official Zoning Map needed according to approved Ordinance #01-2015
     
Tabled until the next board meeting.

      Future Comprehensive Plan Meetings – Wed., August 26, 2015 at 6:00 p.m. here at the Town Hall.  This
      meeting will not be a joint meeting with the Village of Black Creek.

 l.)  Permits Issued/Approvals/Violations (Building & Misc.) –Bob Schwister -– Culvert Permit –

      New culvert extension permit received by Roman Thiel.

      New culvert permit (field entrance) for Mike Salter Jr.    

      MOTION:  Neubert/Rettler to approve the 2 culvert permits, one for Mike Salter Jr., and one for Bob
      Schwister.  All said aye.  Motion carried.

Garage with no electric was built on County Rd PP by Mumford.  Building looks like a cabin.  Town Board
checking into. 

m.)  FIRE/AMBULANCE – PAST DUE FIRE/RESCUE RUNS – Jason Vanderwegen $396.00; Cody Plaster $714.25;
       Chelsey Keller $797.50, Tyler Schulz $766.50
MOTION:  Neubert/Rettler to remove Tyler Schulz from the
       collectable list.  All said aye.  Motion carried.   Letter was read from our town attorney in regards to the
       Tyler Schulz’s collection process. 

       — Received $25 payment for Vanderwegen from Attorney.
           
       Town Ordinanceneeded for Fire Dept. to bill insurance companies for runs

       meeting.   New Ambulance Run $749.25 Ann Marks – Dan Knutzen will bring the run information to our
       Town Attorney. 

n.)   Ryan Rohan – Hwy 54 Recycling Compliance ResultsKnutzen has been talking to Rohan regarding the
        compliance issue.  Knutzen will be getting the Town Lawyer involved. 

o.)   The Board of Review (BOR) has been adjourned to a later time — Set Dates for Open Book and BOR
       Clerk read the email from our Town Assessor.  BOR will be October 29, 2015 from 6:00 p.m. – 8:00 p.m.
       Open Book will be October 14, 2015 with no time mentioned.  Assessor will be mailing the notices around
        9/29/15.  Clerk will let our Assessor know that the dates work for us and ask for his meeting time for the
        Open Book. 

p.) Building Inspector Fees – Paul Hermes MOTION:  Neubert/Rettler to pay Hermes his inspector fees.  All
       said aye.  Motion carried.     

q.)   Appoint New Town Attorney – Take off agenda.  Herrling Clark has provided two new attorneys. 

r.)  Review and Adjust the 2015 Town of Black Creek Fee Schedule – The Town Board will be reviewing the
      fee schedule which will be effective as of 2016.  The Town Board requested our building inspector to
      forwarded suggested building permit fee pricing which will be reviewed at the end of the year but
      effective in 2016. 

Clerk will contact our assessor that the trailer home, Parcel # 010-0564-01, N5557 County PP, has been demolished and Parcel # 010-0703-00 (Previously known as Da Bumpas Sports Pub) at W5697 County Rd A, building has been burned down. 

s.)   2015 Pavement Ratings are due to WisDOT by 12/15/2015—Knutzen will be contacting the County to
       complete the Town’s Pavement Ratings.  The Clerk requested that we get an excel copy when it is
       complete.  WisDOT is the Wisconsin Department of Transportation. 

t.)   Set Date to work on the 2016 Budget and Budget Hearing—Work on Budget 10/21/2015 at 6:00 p.m. and
      the Hearing date will be 11/11/2015 at 7:00 p.m.  The Budget will be adopted at the December monthly
      Town Board meeting.

u.)   Fall Tire and Scrap Metal Collection Day, Newspaper Notice for 9/19/2015 9:00 a.m. – 4:00 p.m.
        Notice for the newspaper will be a class 1 notice for the Monday before the collection day.

The Clerk reviewed the current budget category layout versus an updated format which would include more defined governmental categories.  The categories would be similar to our yearly Form CT which the Clerk prepares for the Department of Revenue yearly.  The Town Board decided to continue with the same budget category layout as we have been using in the past years. 

Fire Department landing pad has been completed.
