BOARD OF SUPERVISORS MEETING
Monday, June 13, 2011
7:00 p.m. Town Hall
The June Board of Supervisor’s meeting was called to order at 7:13 p.m.
Officials present: Chairman Dan Knutzen, 1st Supervisor Dan Rettler, 2nd Supervisor Tom Neubert, and Clerk Karen Herman. Treasurer Jeri Ohman was excused from the board meeting. Resident present: Michael Garvey.
The agenda was posted according to the open meeting law on June 10, 2011.
MOTION: Rettler/Neubert to dispense the reading of the minutes and to approve the May 9, 2011 Town Board Meeting minutes. All said aye. Motion carried.
MOTION: Neubert/Rettler to approve the May 9, 2011 Audit minutes. All said aye. Motion carried.
MOTION: Neubert/Rettler to approve the May 9, 2011 minutes to adjourn the Board of Review to another Date. All said aye. Motion carried.
Building Permits: No New Permit this Month.
a.) Sheriff Dept. – No one present.
b.) Town Hall – Garrow Contract– Clerk informed board that the LP bill was $1.949 per gallon this month.
Discussion took place.
New Town Hall Photocopier – Copier being installed tomorrow 6/14/11.
Hall Septic System Pumped – Rettler contacting J & L from Seymour to pump septic system. Paying
Next month per Rettler.
c.) Roads –
Junk Cars on property – W5449 County Rd A (VerBoomen) – Clerk gave Knutzen a sample letter to
send from the County. Reviewed Zoning Ordinance at meeting. Knutzen looking into.
Destroyed Fire Number in Road Right of Way – Tom Mullen– Neubert has not received fire numbers
from manufacturer.
Multiple addressing numbers on private driveways– Neubert has not received fire numbers from
manufacturer.
Road work bids– POSTING: 6/22/11 5:00 p.m.—Meeting with John Delmore (Scott Construction)
regarding chip sealing road check.
Knutzen indicated that Kropp/Stingle/Wick will be smear patched this summer.
WisDOT Pavement Ratings due 12/15/11 – Knutzen has decided to grant the Outagamie County
Highway Dept. the authority to update information for the Town of Black Creek using WISLR for the
purpose of roadway information updating. The Clerk will send the signed agreement to the County.
Robin Rd—Flow of Water Trapped – Knutzen indicated that the County made a plan to put tile under
the Road to drain into the pond. Knutzen checking into.
New Signage needed—arrows on Wood/Ballard Rd, Curve signage on State Rd – Discussion took place
Tabled until the next board meeting.
d.) Setup hearing dates –Freedom Development – Outstanding issues: Comprehensive Plan
Amendment needed before County Board can give final approval (hearing date was 1/31/2007) &
Clayman Creek Storage zoning changes on map; Town Official Map Approval— Tabled until the next
town board meeting.
e.) Working Lands Requirements– Tabled until the next town board meeting.
f.) Land Division-Subdivision Ordinance – Knutzen contacting Jeff Sanders with Community Planning &
Consulting to work on again.
g.) CSM (Certified Survey Maps)/Preliminary Consultation Requests– None Received.
h.) Ordinance/Permit Violations – None Reported.
i.)Permits Issued/Approvals (Building & Miscellaneous): Andy Gorecki—Driveway; Michael Salter—
Field Entrance –Rettler submitted 3 new permits. John Jaykoski — driveway to house, Joan Talakowski –
field entrance, and Jeff Paltzer — barn entrance. MOTION: Rettler/Neubert to approve the 5 culvert
permits. They were installed properly and approved. All said aye. Motion carried. The permits were
for: Andy Gorecki, Michael Salter, John Jaykoski, Joan Talakowski, and Jeff Paltzer.

Knutzen wants a letter written to the town’s attorney to find out the status of the
above runs and the status of the zoning ordinance comments. No updates have been given.
k.)Set Dates for Open Book and Board of Review–motion–
MOTION: Knutzen/Neubert open book and board of review will be June 29, 2011.
Open book 4:00 p.m. – 6:00 p.m. and board of review will be from 6:00 p.m. – 8:00 p.m. All said aye.
Motion carried.
l.) Writ of Certiorari-Frank Sausen—Appealed by Sausen – Court of Appeals will take place within the
Marathon Courts due to the equalization of case loads.
m.) Licensing Approvals—
Black Creek Sportman’s Club Inc: Class “B” Beer License, Operator Licenses: Thomas Brauer (agent),
Edmund Miller, Renee Miller, Christopher Moeller, Thomas Bluma—
Romy’s Nitingale LLC: Class “B” Beer/”Class B” Liquor License, Operator Licenses: Keith Romenesko
(agent), Dawn Balthazor, Sandra Kohl, Allen Krause, Danial DeBruin, and Charles Blumreich III—
MOTION: Neubert/Rettler we
acknowledge the approvals for Sportsman and Romy’s Nitingale from last month. All said aye. Motion
carried.
MOTION: Retter/Neubert to approve Danial DeBruin, and Charles Blumreich III for operator licenses.
All said aye. Motion carried.
DaBumpa’s Sports Pub: Class “B” Beer/RESERVE ”Class B” Liquor License—Community First Credit
Union named receiver for property—Transfer of license versus New license Fees — This is a reserve
license. According to the DOR, a court order specifically addressing the transfer of license to receiver
(Credit Union) and to also specifically address if the Credit Union should be charged as a new legal
entity ($10,000) or charged as a renewal entity needs to be specifically addressed within the court
order. Clerk emailed Credit Union’s Attorney Steve Krueger.
n.) Town Ordinance needed for Fire Dept. to bill insurance companies – Tabled until the next board
meeting.
o.) Tire Collection/Scrap Metal Day–
Received bill from Reetz Recycling for hauling tires to county $160.00. Take off agenda.
p.) Resolution 05-2011 MABAS Mutual Aid Box Alarm System approval – MOTION: Neubert/Rettler to
approve mutual aid agreement for State of Wisconsin. All said aye. Motion carried.
q.) Resolution 06-2011 Decennial Census Redistricting/Ward plan approval – ROLE CALL VOTE:
Redistricting Ward Plan to remain the same. Neubert=YES; Rettler=YES; Knutzen=YES. 3=YES and 0=NO.
r.) Budget Resolution 07-2011 –
BUDGETED ACCOUNTS
The sum of $459.60 from the account Road Maintenance be transferred to the budgeted Office
Equipment/Office Suppliesaccount to pay the bills.
The sum of $8.00 from the account Road Maintenance be transferred to the budgeted Office
Expenses/Postageaccount to pay the bills. ROLE CALL VOTE: Neubert=YES; Rettler=YES; Knutzen=YES;
3=YES and 0=NO.
s.) Cemetery Veterans Care Reimbursement from County – Tabled until the next board meeting.
t.) Recall Election July 12 or July 19, 2011/Clerk Institute July 12 (full scholarship) – Clerk gave the
board an update that she has received a scholarship to attend the Clerk’s Institute in Green Bay but
since it may be the same week as the election she may have to cancel.
Correspondence taken care of.
The treasurer's report, receipts, disbursements, checking, and money market accounts for totals have been reviewed.
Bills for June were reviewed and discussed.
Motion – Rettler/Neubert to approve the Treasurer’s Report, pay the bills, and to transfer $24,500.00. All said Aye. Motion carried.
