BOARD OF SUPERVISORS MEETING
Monday, January 12, 2015 7:00 p.m. Town Hall
The Board of Supervisor’s meeting was called to order at 7:01 p.m. Officials present: Chairman Dan Knutzen, 1st Supervisor Dan Rettler, 2nd Supervisor Tom Neubert, Treasurer Jeri Ohman, and Clerk Karen Herman. The following were present: Resident Michael Garvey was observing the meeting and Deputy Sheriff John Schuette was present to discuss town issues.
The agenda was posted according to the open meeting law on January 8, 2015.
MOTION: Rettler/Neubert to dispense the reading and approve the December 16, 2014 Planning Commission/Town Board to amend the Town’s Zoning Ordinance Map Public Hearing Minutes as printed. All said aye. Motion carried.
MOTION: Rettler/Neubert to dispense the reading and approve the December 10, 2014 monthly town board meeting minutes as printed. All said aye. Motion carried. Neubert reported the following errors with the minutes: Topic letter “k” add the word “of”; and topic letter “g” change “tire” to “tile”.
MOTION: Neubert/Rettler to dispense the reading and approve the December 11, 2014 Planning Commission/Town Board meeting minutes as printed. All said aye. Motion carried.
Building Permits:
No Building Permits to report
Agenda items were taken out of sequence.
Deputy Sheriff John Schuette discussed town issues first and did not stay for the remainder of the meeting.
a.) Computer Upgrade for Treasurer– Treasurer will not be pursuing until after tax collections are completed.
b.) Jason Volkman – Personal Property Tax Refund Request 010-9903000 Trailer Home Removed from
Property November 2013– Treasurer reported that this personal property tax amount $61.34 does not
qualify for charge back procedures. Town and Assessor were not notified that the trailer home was
removed from the property. Assessor has now been notified. MOTION: Neubert/Rettler to keep trailer
home tax on the property tax bill. All said aye. Motion carried. No deductions given.
c.) Sheriff Department – Deputy Sheriff John Schuette was available to discuss town issues.
d.) Matt Wilcox – N6484 12 Corners Rd, Parcel #010-029101, CSM Split and Rezoned to General Agriculture –
Knutzen reported that Matt would like to sell his house separated from the current parcel and to sell the
divided parcel to his neighbor. Both parcels would be rezoned to general agriculture. Knutzen would
like Jeff Sanders with Community Planning and Consulting and Dave Johnson with the County Planning
Department to be available. Hearing needs to be 2/2 – 2/5. Clerk will be contacting the Planning
Commission to determining the hearing date.
e.) 2015 Wisconsin Certified Newspapers and Rates Email –Discussion took place. Continue as usual per
Knutzen.
f.) Town Hall – Purchase New Refrigerator –New refrigerator install. Take off agenda.
Repair Posting Board Glass at Clerks Home– Replacement doors installed. Clerk reported that the
replacement doors are very difficult to open and close. She is concerned that the key will break off
when opening the door. Neubert will be installing handles on the display board.
Board Room Cabinets – Tabled until the next board meeting.
Hall Well Repaired – Well has been repaired and water has been tested. Take off agenda.
Concrete Filled in at Front Door– Tabled until the next board meeting.
Floor Stripper & Wax– Discussion took place.
g.) Roads–Status of Culvert on Krueger Rd in Front of Norman Steffen’s Home—Field Tile is Lower than the
Culvert–Culvert situation will be checked this upcoming spring. Tabled until the next board meeting.
Cleaning Cross Rd Culvert South of Bissing on 12 Corners Rd –Waiting until spring. Tabled until the next
board meeting.
Plowing Agreement with Town of Center – Chairman has done nothing. Tabled until the next board
meeting.
h.) Planning Commission – Land Division-Subdivision Ord. – No discussion took place.
Response to rezone requests – The Planning Commission Recommendations for the Town Board from the
February 8, 2012 was finally discussed. This meeting took place on February 8, 2012 titled Zoning
Ordinance Changes for the Working Lands Initiative. This process was a part of the Zoning Ordinance re-
write.
The board approved the document by signing their names and dating the document 1/12/2015.
Additional Conditions and Stipulations set by the Town Board of Black Creek were written as: We
responded to the rezones and the remaining were left unchanged. Felt that no response letters were
needed. No formal motion made.
Creation of Base Farm Tract Map; Comprehensive Plan Update Meeting – The clerk will be setting up a
planning commission meeting at 7:30 p.m. preceding the public hearing for Matt Wilcox. Agenda items:
Mary Ott on Cnty Rd P—land division (no parcel or home address given); creation of the base farm
tract; comprehensive plan meeting.

Attorney made an agreement regarding the Lucas Ziewac run payment. Payment of $200 was received
and now it is paid in full.
MOTION: Neubert/Rettler to drop collection for Nooyen and Troiber. All said aye. Motion carried.
Town Ordinanceneeded for Fire Dept. to bill insurance companies for runs –
Tabled until the next board meeting.
Discuss Ambulance Auditing/Bill Procedures – The year-end report is not available yet. Tabled until the
next board meeting.
k.) Town Attorney—Review the Zoning Ordinance and Map; Ordinance Amending the Town’s Zoning
Ordinance and Zoning Map to comply with the new Farmland Preservation Requirements and to maintain
consistency with an updated Outagamie County Farmland Preservation Plan –
Clerk will be emailing the amended zoning ordinance for legal review by our town attorney. Once the
attorney reviews the ordinance, the board will need to adopt the amended zoning ordinance and map.
l.) County Preliminary Reports or Certified Survey Map (CSM) approvals—Wilcox 010-029101;
Tom Beyer 010-072100 and 010-072400 – Wilcox preliminary discussed; Beyer CSM has been approved
and signed.
m.)Year End Budget Resolution 09-2014 –
Beginning Balance in the following accounts:
Checking FCCUaccount = $969.07
Money Market FCCUaccount = $880,930.75
The sum of $969.07balance in the Checking FCCU account be
transferred to the Road Maintenance FCCU reserveaccount.
The sum of $821,801.06(December 2014 Tax Collections)
plus the remaining sum of $59,129.69balance in the General Money Market FCCU
account be transferred over to a combined transfer total of $880,930.75 in the
Road Maintenance FCCU reserve account.
The new balance in the above accounts will be:
$0 Checking FCCU account.
$0 General Money Market FCCU account.
$881,899.82 Road Maintenance FCCU Reserve account.

New Year Budget Resolution 01-2015 —
The sum of$969.07 be transferred from the Road Maintenance FCCU
reserve account and put into the Checking FCCU account to get in
balance with the Treasurer’s checking account year end balances.
The sum of $821,801.06 (December 2014 Tax Collection) be
transferred from the Road Maintenance FCCU Reserve account and put
into the General Money Market FCCU account.
The new balance in the Road Maintenance FCCU Reserve account will be
$59,129.69.
The new balance in the Checking FCCU account will be $969.07.
The new balance in the Money Market FCCU account will be $821,801.06.
Budgeted Expense Accounts
The sum of$86.00 be transferred from the Election budgeted expense
account and put into the Attorney/Legal budgeted expense account to pay
the January town attorney bill.

n.) Ryan Rohan—Hwy 54 Recycling Compliance Letter– Discussion took place. Response received from
Rohan. Board looking into situation.
Treasurer’s Report on receipts, disbursements, checking, and money market accounts for totals.
Clerk Presents Bills and Transfers Money to Pay Bills.
MOTION: Neubert/Rettler to purchase projector screen for $300. All said aye. Motion carried.
MOTION: Neubert/Retter to accept the treasurer’s report, approve and pay the bills and to transfer
$696,800.00 to pay the bill. All said aye. Motion carried.
Correspondence taken care of.
The 2/17/15 Primary Election for the Town of Black Creek will take place at the Shiocton Village Hall. Shiocton School Referendum is on the ballot.
Budget sheets header page shows 2014 but the year should be 2015.
Total bills for January: Fox Communities = $696,232.01
List of January bills are attached.
