TOWN OF BLACK CREEK,
OUTAGAMIE COUNTY, WISCONSIN
AN ORDINANCE ESTABLISHING AND LIMITING THE DUTIES OF THE
TOWN CONSTABLE
Be it hereby ordained, by the Town Board of the Town of Black Creek, Outagamie County, Wisconsin, as follows:
SECTION I – TITLE AND PURPOSE
The title of this ordinance is the Town of Black Creek Duties of Town Constable Ordinance. The purpose of this ordinance is to establish and limit the duties of the Town Constable.
SECTION II – AUTHORITY
The Town Board has the specific authority to adopt this Ordinance under Wis. Stat. §§ 60.22(4) and 60.35(1) and general authority under its village powers under Wis. Stat. § 60.22(3).
SECTION III – ADOPTION OF ORDINANCE
This ordinance, adopted by a majority of the Town Board on a roll call vote with a quorum present and voting and proper notice having been given, establishes and limits the duties of the Town Constable as set forth herein.
SECTION IV – DUTIES OF TOWN CONSTABLE
The Town Board does hereby establish and limit the Town Constable’s duties to the following:

The Town Constable shall be responsible for animal control within the Town of Black Creek. The Town Constable shall refer all other Outagamie County ordinance and / or Wisconsin state statute violations and enforcement matters to the Outagamie County Sheriff’s Department.

The Town Constable shall assist other law enforcement agencies, fire departments, ambulance and rescue service squads, and other emergency personnel as directed from time to time by the Town Board or Town Chairman.
SECTION V – COUNTY ORDINANCE AND / OR STATE STATUTE VIOLATIONS
The Town Constable shall promptly report to the Outagamie County Sheriff’s Department all observations and reports of violations of Outagamie County ordinances and / or Wisconsin state statutes occurring within the Town of Black Creek. The Town Constable has no authority or jurisdiction to intervene in matters constituting a violation of Outagamie County ordinance and / or Wisconsin state statute, unless specifically requested to do so by the Outagamie County Sheriff’s Department under the Outagamie County Sheriff’s Department’s supervision and direction, or unless necessary in emergency situations to protect the safety of persons.
SECTION VI – REPORTS
The Town Constable shall maintain a Constable Log of his or her official activities, including the date, time, and nature of the incident, the names, telephone numbers, and addresses of the individuals and / or property involved, and the disposition. The Town Constable shall prepare a yearly report setting forth the official activities for the year and provide the report to the Town Board at least five (5) days prior to the last Town Board meeting of each year which occurs in December.
SECTION VII – SEPARABILITY OF PROVISIONS
In the event any one or more provisions of this Ordinance are declared invalid, such decision(s) shall not affect the validity of the remaining portions / provisions hereof.
SECTION VIII – EFFECTIVE DATE
This ordinance is effective on publication or posting.
