Planning Commission Meeting Minutes

 

Monday, February 16, 2015                                  7:00 p.m.                                     Town Hall

The Planning Commission Meeting was called to order at 7:16 p.m.
 
Planning Commission members present:  Dan Knutzen (Chairman), Norman Steffens,
William West, Michael Garvey, and Lee Lemke. Clerk Karen Herman was present.  Jeff Sanders with Community Planning and Consulting and Dave Johnson with the Outagamie County Planning Department were also present.

 

The agenda was posted according to the open meeting law February 12, 2015 at the
3-posting places and web site.
 

MOTION:  Lemke/West to approve the Planning Commission Meeting Minutes from December 11, 2014 and December 16, 2014.  All said aye.  Motion carried.

Dan Knutzen wanted to discuss the Matt Wilcox Public Hearing which is going to take place tonight at 8:00 p.m.  Most of the property is in wetlands.  Possible building restrictions were discussed.  Jeff Sanders mentioned that the following 4 state criteria’s are required to be met before rezoning out of exclusive agriculture:  1) If the rezone will better suit the usage of the land, 2) If the rezone is consistent with the Town’s Comprehensive Plan, 3) Substantially fits with the Outagamie County Farmland Preservation Plan, and 4) Doesn’t substantially limit or impair other surrounding property.

 

a.  Mary Ott, N6677 County Rd P, Requesting Land Division with Parcel #010 013501
     Jeff and Mary Ott would like to split off 4 or 5 acres with the house and sell the
     remaining acres as farmland.  Discussion took place.  It was determined that the best
     recommendation would be to allow the certified survey map (csm) house split be
     rezoned from exclusive agriculture to general agriculture and the remaining parcel
     stay exclusive agriculture.  A public hearing date will need to be set.


b.  Creation of the Base Farm Tract Map
Jeff Sanders mentioned that Ben Wildenberg
      can do the creation of the digitized map plan.  The base farm tract would be setup
      into 3 levels.
          
c.  Upcoming joint Comprehensive Meeting with the Village of Black Creek on 3/30/15 at
     6:00 p.m. at the Town Hall
– Chapter 5 Transportation and Chapter 6 Utilities will be
     discussed at the March 30, 2015 joint meeting.

 

d.  Lawyer Reviewed and Updated the Zoning Ordinance  —  Jeff Sanders said that the
      next step is to have the Town Board adopt by ordinance the Town of Black Creek’s
      Zoning Ordinance with the town Attorney’s recommendations (minor changes). 
      DATCP will not need to reapprove the Attorney’s minor recommendations.

 

e.  Review the Following Zoning Ordinance Draft Applications:  Appeal of Variance, Conditional Use Permit, Site Plan Review, Zoning Change– Jeff explained that money should not be accepted until the application forms are filled out completely.
