Planning Commission Meeting Minutes
Wednesday, January 19, 2011 7:00 p.m. Town Hall
The Planning Commission Meeting was called to order at 7:05 p.m. Planning Commission members present: Merlin Heiden, John Lemke, Norman Steffens, Bill West, and Dan Knutzen (Chairman). Clerk Karen Herman, resident David Vick, Jeff Sanders with Community Planning & Consulting, LLC, and David Johnson from the County Planning Department were also present.
The agenda was posted according to the open meeting law January 14, 2011 at the 3-posting places and the front door of the town hall.
MOTION: Lemke/Heiden to approve the December 15, 2010 planning commission meeting minutes. All said aye. Motion carried.
a. Jeff Sanders (Comm. Planning and Consulting, LLC) will review the revised
zoning ordinance changes– West presented editorial changes for the new Zoning Ordinance to
Sanders. Sanders indicated that the Ordinance will proceed with the following steps:
1. County—review Zoning Ordinance
2. Town Attorney—review Zoning Ordinance
3. Pre-Public Hearing—(Town Board approved) to send Zoning Ordinance to DATCP
5. Planning Commission’s recommendation to the Town Board for adoption.
6. Town Board zoning ordinance approval/adoption.
7. Final Draft — approval with DATCP (Madison).
8. Public Hearing (can include subdivision/land division ordinance and any changes with
exclusive agriculture zoning)
b. David Johnson (Outagamie Planning Dept.) – Working Lands Discussion–
Johnson indicated that the updated Zoning Ordinance has no conflicts with the County. The
County incorporates decisions from the Town of Black Creek Zoning Ordinance into the Counties
Zoning Ordinance. The County Board has final approval of all rezones out of exclusive agriculture.
The County will be updating the Town’s Zoning Map and creating the Town’s Official Map. The Town
will need to give the County a list of parcel numbers which will be changed from Exclusive Agriculture
zoning to General Agriculture zoning.
c. Paperwork necessary to send zoning ordinance to Datcp–
MOTION: Heiden/Lemke Recommendation to Town Board for a pre-public hearing with the Town
Board approved amended zoning ordinance with final edits. All said aye. Motion carried.
d. Review/Motion—Certified Survey Map for David Vick parcel #010028600–
Tabled CSM until DATCP approves Zoning Ordinance.
e. Review/Motion—Certified Survey Map for Thomas Dudley parcel #0100043-01–
MOTION: Lemke/Heiden approved statement stating on CSM that “lot 2 cannot have a permanent
structure built on this lot”. All said aye. Motion carried. This statement will need to be added to
the CSM for lot 2.
f. Sign Recommendations to Town Board– completed.
g. Set Date/Time for Next Planning Commission Meeting– Next meeting will be setup
Motion – Lemke/Heiden to adjourn at 8:55 p.m. All said aye. Motion carried.
