BOARD OF SUPERVISORS MEETING

The May Board of Supervisor’s meeting was called to order at 6:57 p.m.
Officials present: Chairman Dan Knutzen, 1st Supervisor Dan Rettler, 2nd Supervisor Tom Neubert, Treasurer Jeri Ohman, and Clerk Karen Herman. Others present: Deputy Sheriff Travis Linskens (left at 7:05 p.m.), Tom & Dolly Conradt (left at 7:13 p.m.), Charles and Paul Riehl, and Michael Garvey.
The agenda was posted according to the open meeting law on May 5, 2011.
Motion – Rettler/Neubert to dispense the reading of the minutes and to approve the April 11, 2011 Town Board Meeting minutes. All said aye. Motion carried.
New Building Permits– None
Wind took roof off of Tom & Dolly Conradt’s trailer at N5872 State Rd. Wanting this trailer taken off of his property taxes. They will be contacting the Town Assessor Scott Borree.
Discussion also took place regarding the signage which is need on the large curve on State Rd.

a.) Sheriff Dept. – Deputy Sheriff Travis Linskens was available to talk about town theft issues.
b.) Town Hall – New Coffee Maker– New 100 cup coffee maker was purchased. Take off agenda.
New Town Hall Photocopier – MOTION: Neubert/Rettler to purchase new copier machine $4,056 with
maintenance program at 0.0103 cents per copy. All said aye. Motion carried. The $4,056 includes
$250 for extra paper drawer.
Hall Septic System Pumped – Rettler contacting J & L from Seymour to pump septic system. Pay next
month.
c.) Roads –
Charles and Paul Riehl has zoning questions, conditional use permit questions, and questions regarding
pole shed and commercial building requirements.
Trapped water on Robin Rd – Knutzen checking into putting tile under roadway.
Junk Cars on property – W5449 County Rd A (VerBoomen)– Per Knutzen, the County will be sending
us a copy of their junk car ordinance.
Destroyed Fire Number in Road Right of Way – Tom Mullen– Tabled until the next board meeting.
Multiple addressing numbers on private driveways– Tabled until the next board meeting.
Road work bids– Knutzen indicated that the roads will be checked for chip sealing this week.
Set date to take down road weight limit signs – Motion – Do posting: May 12-14 8 a.m. until
completion to take weight limit signs down.
Schwind Trucking LLC Disposal Permits: Darrin Stingle, farmer/Tom Beyer, property owner; Danial
Knutzen, farmer/Ralph Lorenz, property owner; Robert Schmidt, farmer/Dwight Wickesberg,
property owner– MOTION: Neubert/Rettler to accept the dumping per site permits. All said aye.
Motion carried.
WisDOT Pavement Ratings due 12/15/11 – Knutzen indicated that he has hired the County to do the
pavement ratings for him.
d.) Setup hearing dates –Freedom Development – Outstanding issues: Comprehensive Plan
Amendment needed before County Board can give final approval (hearing date was 1/31/2007) &
Clayman Creek Storage zoning changes on map; Town Official Map Approval— Tabled until the next
town board meeting.
e.) Working Lands Requirements– Tabled until the next town board meeting.
f.) Land Division-Subdivision Ordinance – Tabled until the next town board meeting.
g.) CSM (Certified Survey Maps)/Preliminary Consultation Requests– Preliminary consultation list has
been received from the County for Rose Pantzlaff. Knutzen saw no concerns with the preliminary.
h.) 2% Fire dues submission approval – Town Board signed submission approval.

Fire Inspection Reports—Violations for Forest Mini Storage – additional fire extinguishers and the
mounting of extinguishers is required. Fire Inspection Services Inc. has turned this issue over to Chief
Yahle for disposition.

We will receive dates for Open Book and Board of Review this coming Wednesday 5/11/11 from Borree
Services.

expense records — approval– MOTION: Rettler/Neubert to approving alternates and confidentiality

n.) Licensing Approvals—
Black Creek Sportman’s Club Inc: Class “B” Beer License, Operator Licenses: Thomas Brauer (agent), Edmund Miller, Renee Miller, Christopher Moeller, Thomas Bluma—MOTION: Neubert/Rettler to approve the licensing for the Black Creek sportman’s Club Inc. for the class “B” beer license and operator licenses for Thomas Brauer (agent), Edmund Miller, Renee Miller, Christopher Moeller, and Thomas Bluma. All said aye. Motion carried.
Romy’s Nitingale LLC: Class “B” Beer/”Class B” Liquor License, Operator Licenses: Keith Romenesko (agent), Dawn Balthazor, Sandra Kohl, Allen Krause—MOTION: Neubert/Rettler to approve the licensing for Romys “Class B” Liquor and Class “B” Beer licenses and operator licenses for Keith Romenesko (agent), Dawn Balthazor, Sandra Kohl, and Allen Krause. DaBumpa’s Sports Pub: Class “B” Beer/”Class B” Liquor License—This is a reserve license. A court order is needed to take over this current license.

of the Village’s ordinance to keep them consistent.
p.) Budget Resolution 03-2011–
BUDGETED ACCOUNTS
The sum of $31,824.00 from the account Road Maintenance be transferred to the budgeted
Ambulance Runs account to pay the bills. The sum of $5.00 from the account Road Maintenance be
transferred to the budgeted dues account to pay the bills. The sum of $148.00 from the account Road
Maintenancebe transferred to the budgeted Office Equipment/Office Supplies account to pay the

q.) Purchase Election Machine Approval – MOTION: Knutzen/Rettler to buy one Edge reconditioned for

r.) Tire Collection/Scrap Metal Day – ¾ dumpster with scrap metal and 1 dumpster with tires. All went
well.
s.) Help with Black Creek Centennial Celebration – 150 yrs.; June 2012 Family Dazes Celebration –
Discussion took place.
t.) Approval of New Federal Requirements for the 457 (b) FICA replacement plans with Nationwide
Retirement Solutions– MOTION: Knutzen/Neubert to continue on with Nationwide. All said aye.
Motion carried. Plan Sponsor Signature Page was signed by Knutzen. Clerk will return to Nationwide
Retirement Solutions.
u.) Ordinance—Liquor Licensing–Approval–
RESOLUTION NUMBER #04-2011–Liquor Licensing
ADOPTING THE LIQUOR LICENSING QUOTA
WHEREAS, the Town of Black Creek has the following quota for Liquor Licensing:
1 Regular Liquor License which requires the normal filing
3 Reserve Liquor Licenses which requires the normal filing
plus the extra $10,000 which the Town retains.
This information is based on how many licenses were in existence in 1939 which was 5 and the 1 license in existence December 1, 1997. BE IT RESOLVED by the TOWN BOARD OF THE TOWN OF BLACK CREEK to implement the above quota.
Role call vote: Neubert—Yes; Rettler—Yes; Knutzen—Yes; 3 YES and 0 No.
Treasuer: We have delinquent Personal Property taxes due for Brett Robley for $215.00. In the beginning of 2012, Jeri can pursue a refund from the school districts, county, and state.
Correspondence taken care of.
MOTION: Rettler/Neubert to pay $15.00 membership to Newton Blackmour State Trail Friends Group. All said aye. Motion carried.
The treasurer's report, receipts, disbursements, checking, and money market accounts for totals have been reviewed.
Bills for May were reviewed and discussed.
Motion – Neubert/Rettler to accept the Treasurer’s Report and to transfer $34,000.00, to pay the bills. All said Aye. Motion carried.
