Town Board Meeting Minutes

TOWN OF BLACK CREEK
BOARD OF SUPERVISORS MEETING

Monday, April 8, 2013                                                                7:00 p.m.                                                                           Town Hall

The April 2013 Board of Supervisor’s meeting was called to order at 7:00 p.m.

Officials present:  Chairman Dan Knutzen, 1st Supervisor Dan Rettler, 2nd Supervisor Tom Neubert,
Clerk Karen Herman, and Treasurer Jeri Ohman.  

Andy Gayhart with Harters Fox Valley Disposal was present to discuss garbage collection questions and left the meeting at 7:36 p.m.  Deputy Sheriff Lastuski was present to discuss town issues and left the meeting at 7:07 p.m.  Sharon Natchwey was present to discuss the American Transmission Company Lines Project and left the meeting at 8:25 p.m.  Brian Gruendemann was present to discuss the town roads status and left the meeting at 8:49 p.m
 

The agenda was posted according to the open meeting law on April 4, 2013.

MOTION:  Rettler/Neubert to dispense the reading of the minutes and accept the March 11, 2013 monthly TOWN BOARD MEETING minutes as presented.  All said aye.  Motion carried.

Building Permits:  Bob Kuehnl – Electrical permit (received from Paul Hermes with $50 payment)
 

a.)  Sheriff Department
       Discussion took place with Deputy Sheriff Lastuski regarding town issues.

b.)  Andy Gayhart—Discuss the Harter Disposal contract with detail to pickup items
       Three 33 gallon size garbage cans of normal household waste are allowed per week.  Large items can be
      broken down to fit in a garbage can with the normal weekly pickup.  Once a month, large items over
      3-feet are picked up for a separate fee by contacting Harters.  Dumpsters are available by contacting
      and paying Harters for anyone in need of larger garbage collections.
 

c.)  (ATC) American Transmission Company—Transmission Line Project– Sharon Natchwey was present
      and concerned as to why no one represented the Town of Black Creek at the local meetings regarding
      the transmission line project.  People don’t care to have the transmission lines running through their
      property and it may go where we get the least complaints.  Knutzen said he will check into this and
      discuss it at the annual meeting.
      
d.)  Town Hall – New Corkboard for Outside Display CaseThe display case costed $393.  Rettler plans
      to pickup our new outside display case tomorrow from DePere.

      Skinkis Lawn & Landscaping LLC-Lawn Maintenance Contract– Mowing $85; Plant Bed Maintenance
      $3.50  MOTION:  Neubert/Rettler to accept Skinkis lawn mowing agreement.  All said aye.  Motion
      carried.
       

e.)  Roads

      Brian Grundermann was present to discuss the town roads issues:

      Town road patching was done and on Ballard Rd he cleaned out the brush and chipped stumps.

      Wolf Rd – Grundemann and Rettler plan to stake Wolf Rd as a 3-rod road by the woods so the brush can
      be cleaned out in the ditches.  Genske Rd culvert – cutting down the heaved blacktop.
      Schimmelpfenning – bad culvert.
      Resident requesting speed limit sign 15 mph on Robin Rd-Ordinance to lower speed limit
      Board reviewed the following road papers received from the Wisconsin Town’s Association:  Speed
      Limits & No-Parking Areas, Setting Speed Limits on Local Roads, and Ordinance to lower speed limit on
      town highways.  The Clerk is to place a 2-week notice with the ACN/Times Press:  Robin Road speed
      limit will be set to 35 mph effective May 1, 2013.  Town Chairman, Dan Knutzen

      Request for Ditches to be Cleaned on Ballard Rd (Burma Swamp) – Bushes were trimmed and stumps
      chipped.  It opened the road up and cleaned up nice.  Take off agenda.

      Stake Clearing Bid with Houle Enterprises – Ballard Road staking has been completed.  Take off
      agenda.    

      Weight Limits on Roads– East of County Rd PP are 6 ton and West of County Rd PP are 8 ton weight
      limits posted.  Discussion took place as to when to take down the weight limit signs.  This will be
      further discussed at the annual meeting.
      2013 Bids – Not needed.  Take off agenda.

f.)  Setup hearing dates –Freedom Development – Outstanding issues:  Comprehensive Plan
      Amendment needed before County Board can give final approval (hearing date was 1/31/2007) &
      Clayman Creek Storage zoning changes on map; Town Official Map Approval/Working Lands
      Requirements/Land Division-Subdivision Ord. // Response to rezone requests
– 
      DATCP (Dept. of Trade and Consumer Protection) has notified the town that there are still discrepancies
      with the town and county zoning maps, they do not match. Knutzen reported that according to Dave
      Johnson with the Outagamie County Zoning Department, it is much easier for the town to change their
      zoning map and to amend it later then it would be for the county.  This will require a 2 week posting of
      the hearing.  Knutzen will be contacting Dave Johnson for the posting requirements. 

g.) Ordinance/Permit Violations—Kropp Rd ditch filled in by resident Duane FeltonThe ditch has been
     cleaned out and now the problem is upstream.  Keep on agenda.

h.)  Permits Issued/Approvals (Building & Miscellaneous)No updates from Rettler.  Paul Hermes sent a
      electrical permit and $50 payment from Bob Kuehnl.

i)  FIRE/AMBULANCE –PAST DUE FIRE/RESCUE RUNS

       2013 radio system upgrade.

k.)   Budget Resolution 2-2013Not needed this month.
                      

l.) April 2, 2013 General Election – 167 voters with 1 absentee ballot not returned.  The MBOC (Municipal
     Board of Canvassers) had to reconvene on Friday, April 5 to finalize the election paperwork.

m.)  Free Tire Recycling/Scrap Metal Day Date:  Spring 4/13/2013
       
Neubert contacting Reetz Recycling to deliver dumsters.

n.)  Refinance Fire Hall Building Loan (joint with Village) – Knutzen informed the board & Village of Black
      Creek that the new loan papers have not been completed so the town needs to make the normal
      payment of $29,009.70 to BMO.  Clerk will be contacting Penni at BMO to find out how much of the
      payment will be interest.

o.)  BOR Appeal to Wis. Supreme Court – Frank Sausen –Tabled until the next town board meeting.

p.)  Annual Meeting April 16, 2013; Posting/Food/Drink – 4-H will be providing the food and Rettler will
      be purchasing the drink.

q.)  Set Date to Audit Clerk and Treasurer Financial Books – May 16, 2013 at 6:45 p.m.

r.)  Polling Place Accessibility Compliance Audit Report – response of action due 3/27/13
      Discussion took place to resolve entrance concrete landing which will be completed in June or July.
      Response of action previously submitted.

s.)  2% Fire Due—approval due 4/1/13 online – Clerk informed board that she completed the paper work
     online 3/21/13.  The board approved a document which verifies the dates of all fire runs, meetings, and
     trainings.

t.)  Set Date for Open Book and Board of Review – 6/6/13 open book 4p – 6p, and board of review 6p – 8p.

     Clerk will verify the date and times with Borree Services in the morning.

     Ordinance to Appoint Alternate Members for Board of ReviewMOTION:  Neubert/Rettler to accept
     Board of Review Alternates:  William West, Brian Gruendemann, Michael Garvey, Bev Neubert, and Jeri
     Ohman.  All said aye.  Motion carried.

    Ordinance Relating to Confidentiality of Income and Expense RecordsMOTION:  Rettler/Neubert to
    accept the confidentiality of Income and Expenses ordinance.  All said aye.  Motion carried.

u.)  May 13, 2013 Town Board Meeting Date Changed – Board changed the date to May 16, 2103 due to
      conflict with scheduling.

Correspondence taken care of.
 

The treasurer's report, receipts, disbursements, checking, and money market accounts for totals have been reviewed.

MOTION:  Neubert/Rettler to accept the Treasurer’s Report, approve and pay the bills and to transfer $66,500.00 to pay the bills.  All said aye.  Motion carried.
