Thursday, May 29, 2014                                     7:00 p.m.                                                 Town Hall

The Planning Commission and Town Board Meeting was called to order at 7:02 p.m. 

The following were present at the meeting:
Planning Commission members:  Michael Garvey, Lee Lemke (arrived at 7:11 p.m.), Norman Steffens, William West and Dan Knutzen (Chairman). 
Town Board members:  Tom Neubert, and Dan Rettler. 
Clerk Karen Herman.  Guests:  Dave Johnson, Assistant Planning Director with Outagamie County and
Jeffrey Sanders with Community Planning and Consulting LLC. 
Attorney David VanStraten and Merlin & Audrey Doell (Trustee of the Springstroh property) (all three left at 7:33 p.m.).

The agenda was posted according to the open meeting law May 23, 2014 at the 3-posting places.

a.)  Springstroh Property 010 058600 (.93 acres) Split 2 Homes with Shared Driveway, Well, and LP Tank
Attorney David VanStraten and Merlin & Audrey Doell (Trustee of the Springstroh property) were present to discuss possible land division issues.  The property is currently being sold as one parcel.

b.)  Planned Use of a Wood Chipping Company at N5285 Hwy 47 (010 072200) CS Rentals LLC Property.  Possible Issues and Verifying that Commercial Zoning is AppropriateDiscussion with no decision.  Take off agenda.

c.)  Lois (Robert) Volkman 010 078400 (38.7 acres) and 010 078100 (20 acres) Building New HomeA CSM (Certified Survey Map) will need to be done.  A conditional use permit application also needs to be done because there can only be one farm residence per farm track.  Once approved, the land change will need to be reported to DATCP and the County.

d.)  Any other Certified Survey MapsNone.

e.)  Certified Zoning Ordinance AdoptionMOTION:  Lemke/West to approve the DATCP Certified Town of Black Creek’s Farmland Preservation Zoning Ordinance text dated March 28, 2014 and map dated February 26, 2014.  All said aye.  Motion carried.  The map available for the meeting tonight was dated 2/25/14.  Jeff Sanders will verify that this is the same map as dated 2/26/14 which was certified with DATCP.  Once the 2/25 map is verified, the map date will be updated to 2/26.  

Farm track mapping system will need to be created along with a parcel number mapping system for the Town.

f.)  Review the Required Next Steps Before the Ordinance Can Take Full Affect

  1. County Board approval of Zoning Ordinance
  2. Town must publish the ordinance after adoption.
  3. Town must send a letter or resolution to DATCP confirming adoption of the amended and certified ordinance.
    Once these steps have been completed the farmland preservation components of the ordinance are
    formally in place. At some point thereafter, the Town will want to begin coordination with Outagamie County to ensure that the agreed-upon plan amendments are completed. 
  4. Public hearing (class 2) with list of parcels to be rezoned back
  5. OnceTown approves, send to county board for approval
  6. By 3/1 send DATCP yearly list of rezones

MOTION:  Nuebert/Rettler to approve the DATCP Certified Town of Black Creek’s Farmland Preservation Zoning Ordinance text dated March 28, 2014 and map dated February 26, 2014.  All said aye.  Motion carried.

MOTION:  Rettler/Neubert to adjourn at 8:13 p.m.  All said aye.  Motion carried.
