BOARD OF SUPERVISORS MEETING

   

Monday, March 9, 2015                                      7:00 p.m.                                            Town Hall


The Board of Supervisor’s meeting was called to order at 7:10 p.m. 

Officials present:  Chairman Dan Knutzen, 1st Supervisor Dan Rettler, 2nd Supervisor Tom Neubert, Treasurer Jeri Ohman (left at 8:00 p.m. after Treasurer agenda items were discussed), and Clerk Karen Herman. 

Others present:  Deputy Sheriff Chad Grube was present to discuss town issues (left at 7:32 p.m. after town issues were discussed); and Resident Michael Garvey was observing the Town Board meeting.

The agenda was posted according to the open meeting law on March 4, 2015. 

MOTION:  Rettler/Neubert to dispense the reading and approve the February 9, 2015 Monthly Town Board Meeting Minutes.  All said aye.  Motion carried. 
 

MOTION:  Rettler/Neubert to dispense the reading and approve the February 16, 2105 Special Town Board Meeting Minutes.  All said aye.  Motion carried.  This meeting followed the Matt Wilcox Public Hearing.

Building Permits:         
None Reported                               

a.)  Sheriff Department– Deputy Sheriff Chad Grube was available to discuss town issues.      

b.)  Tom Trinko’s Building Site Plan with Setbacks, W5697 County Rd A– The site plan was reviewed for a
       storage garage 45’ x 108’.  Setbacks showed the backyard or South side 10 feet and East side 8 feet. 
       MOTION:  Neubert/Rettler to accept the setbacks at 13 feet back (South) and 8 feet East side.  All said
       aye.  Motion carried.  A copy of the site plan is attached to the minutes.

c.)  Computer Upgrade for Treasurer3 new computer options were reviewed.  MOTION:  Neubert/Rettler to
       accept the Lenova ThinkPad E550 Laptop $895 and the Office 2013 Home and Business software $230. 
       All said aye.  Motion carried.

d.)  Treasurer’s Report on receipts, disbursements, checking, and money market accounts for totals

       Fox Communities Credit Union (FCCU) withdrew $8.00 (Returned Check Fee), NSF Check $1,100.45 (tax
       collection check), and Transaction Fee for $5.70 from the checking account. 

       January 31, 2015 the Treasurer sent a tax collection payment letter including the additional $20 NSF fee
       to the tax payer whose check did not clear.  Treasurer had FCCU reverse withdrawal so the NSF check is
       withdrawn from the money market account instead of the checking account.  This change will be
       reflected on next month’s treasurer Financial Report.

e.)  Clerk Presents Bills and Transfers Money to Pay BillMOTION:  Neubert/Rettler to accept the Treasurer’s
       report, approve the bills, and transfer $36,700.00 to pay the bills.  All said aye.  Motion carried.    

Black Creek Fire Department – Fraud/Scam occurred 2-weeks ago with the Black Creek Fire Department checking account.  Checking account closed before funds were withdrawn.

f.)   Licensing Publication Fees $35 for Each ApplicantMOTION:  Neubert/Rettler to increase fee to $35.00
       for the newspaper publication fee.  All said aye.  Motion carried.  This fee is billed to each beer or
       beer/liquor licensing applicant.

g.)  Tire and Scrap Metal Collection Day:  April 18, 2015 and September 19, 2015—Publication in
       Newspaper/Annual ReportPlace notice in newspaper the Monday before the collection day and in
       the annual report.

h.)  Town Hall

      Board Room CabinetsTabled until the next board meeting.        

        Concrete Filled in at Front DoorTabled until the next board meeting.

      Projector Pull Down Screen ProposalThe clerk contacted Suess Electronics for a projector screen
      proposal.  The screen options Neubert wanted was for a basic manual pull down screen.  Four options
      from Suess Electronics were presented to the board.  MOTION:  Neubert/Rettler to purchase $179.00
      Da-Lite, Manual Projection Screen, 16:10 Format, Wall Mountable (White Housing), overall Length 87 3/8”.
      All said aye.  Motion carried.  Suess Electronics will be billing the town.

      Hall Shredded Paper Give to Patti LaFave for KennelPer town board, Patty can have the town hall
      shredded paper to use at her kennel.        

i.)  Roads–Status of Culvert on Krueger Rd in Front of Norman Steffen’s Home—Field Tile is Lower than the
      Culvert
– Board will be checking into this situation.

      Cleaning Cross Rd Culvert South of Bissing on 12 Corners Rd Board will be checking this situation out.

 Schimmelpfenning Rd off of County Rd PP located by first house, the culvert has fallen in (rusted out).
 Board will be checking into this situation.

      Set Date to Install Weight Limit Signs on Town Roads Clerk will do a posting that the weight limit signs will
      be placed on the town roads from March 18th through the 20th from 8:00 a.m. until dark and completion.

      Purchasing New Road Signs – New road signs were delivered to the Clerk’s home.

      Ditch Repair on 12 Corners Rd from Accident – $750 for repairs – Brian Gruendemann (E & G Restoration)
      will be taking care of this situation.  Knutzen received the accident report showing where the bill for the
      road repairs should be sent but he didn’t bring it to the board meeting.

      Kropp Rd & Krueger Rd Pot Holes – Cold patch has been ordered and will be delivered to Brian
      Gruendemann’s (E & G Restoration) home.     

j.)  Planning Commission – Creation of Base Farm Tract MapTabled until the next board meeting.

     Updating the Comprehensive Plan Update Meeting with the Village of Black Creek 3/30/15 at 6:00 p.m. at
     the Town Hall
The meeting is all set.

MOTION:  Neubert/Rettler to drop the Lisa Kehl collection based on the recommendations from our Town
     Attorney.  All said aye.  Motion carried.

      Clerk reviewed all run collection information from attorney.
         
      Town Ordinanceneeded for Fire Dept. to bill insurance companies for runs
      No discussion.

m.)  Town Attorney—Review the Zoning Ordinance and Map; Ordinance Amending the Town’s Zoning
       Ordinance and Zoning Map to comply with the new Farmland Preservation Requirements and to
       maintain consistency with an updated Outagamie County Farmland Preservation Plan

       Clerk will check with Dave Johnson, County Planning Dept., to find out the proper procedure to publish
       the new zoning ordinance.
       MOTION:  Neubert/Rettler to accept the amended ordinance.  All said aye.  Motion carried.  Ordinance
       #01-2015.

       MOTION:  Rettler/Neubert to accept the new version of the Zoning Ordinance.  All said aye.  Motion
       carried.  The new updates includes the Attorney’s recommendations.

       An Updated zoning map is needed.

n.)   County Preliminary Reports or Certified Survey Map (CSM) approvals—
        Knutzen reviewed the preliminary report for the Ronald Volkman property.

o.) Budget Resolution 03-2015
       BUDGET ACCOUNT

       The sum of $1,041.00 from the Educational Meetings & Exp. budgeted account be transferred to the
        budgeted category Miscellaneous to pay the bills.  (Due to an NSF check $1,100.45)

p.)   Ryan Rohan—Hwy 54 Recycling Compliance Letter– No updates were given.

q.)  Legislative Reference Bureau LRB-0665/2—Outagamie Would Like the Boards Input – Clerk is to email that
       the Board feels that we have no position on this subject.

r.)   Resolution 04-2015 Opposing County Assessments– Resolution is #03-2015 and not 04-2015.
       Rol1 call vote to approve Resolution #03-2015.  Knutzen-Yes; Rettler-Yes; Neubert-Y      3=Yes and 0=No

       Clerk will send the Ordinance to Gov. Walker, Senator Cowles, and Rep. Steineke which was
       recommended by the WTA.

s.)   Change Monthly Town Board Meeting Date from 5/11/15 to 5/12 15 – Meeting date will be Thurs. 5/14.

t.)   Invite to Attend Bill West’s Meeting on 4/10/15 from 9:30 a.m. – Noon with DOT– Clerk will let Bill know that
       3 are planning to attend and a posting will be done.

u.)   Ordinance #01-2015 to Amend the Black Creek Zoning Ordinance & Map to Comply with the new
       Farmland Preservation Requirements with the Town Attorney Reviewed
– Motion to approve is located
       under item m) above.

v.)   $50 Fee Due to County for Rezoning Fee for Matt Wilcox and Megan Mulholland Property– Town will pay
       the $50 rezone county fee.  The check will be mailed tonight and the Clerk will email the form to Dave
       Johnson, County Planning Dept.

w.)   2014 Housing Survey– Discussion took place as to where new homes were built and which homes were
        removed.  Mike Helser single family home removed at N5046 Hample Rd (plans to build a new home in
        the future), Dan Ott trailer home removed at W5801 Kringle Rd but built a new single family home, Leo
        Volkman removed a trailer home but built a new single family home at N5560 State Rd, Scott Holz built
        a new single family home at N5406 County Rd PP, and Dwight Wickesberg at W5951 Genske Rd built a
        new single family home (old home exists but will be tearing down in future). 

x.)   Annual Meeting 4/22/15 at 8:00 p.m. – Agenda, Guest Speakers, Food/Drink, 2-week Notice in Local
       Newspaper
– Place annual meeting notice in newspaper 1 week before the meeting.  4-H will be
       supplying the food.  Clerk is to check with Rep. Steineke, Steve Swanson (Outagamie County Deputy
       Zoning Administrator), and Chris Miller (Outagamie County Recycling Coordinator) to see if they can
       speak at our annual meeting.

       Agenda items:  Change all 8:00 p.m. town meeting start times including hearings and annual meetings
       to 7:00 p.m., new fire equipment truck purchasing next year, and road weight limits.

y.)   April 7, 2015 General Election – Election workers, tabulators, machines, training– Split shift election
        workers:  Katherine Seibers, Carol Theobald, Lois Lemke, Patti LaFave, Joyce Plamann, and William West. 
        Rachel Buell, and Stephanie Bissing will be working the entire day. 

        Clerk will call in tabulators if needed. 

        Two edge machines will be used for this election.  The Public Test and election workers training will be
        conducted by the town clerk on Thursday, April 2, 2015 at 10:00 a.m.

z.)   2% Fire Dues Documents Received by Clerk, Town Board Approving that the List is Complete
       MOTION:  Retter/Neubert to accept the 2% fire dues document.  All said aye.  Motion carried.

aa.)   Review and Adjust the 2015 Town of Black Creek Fee Schedule– Board will be reviewing for next
          month’s meeting.

bb.)   Assessment Resolution #05-2015 to Allow Phone Calls Instead of Showing up for BOR– Tabled until the
          next board meeting.  Posting should say Ordinance #02-2015

On agenda—Boree Services, Assessor, payment and contract, Skinkis (town hall) lawn care maintenance agreement, Town Web Design upgrade.

Knutzen reviewed the Fire Inspection Services reports.
