Town Board Monthly Meeting Minutes

TOWN OF BLACK CREEK
BOARD OF SUPERVISORS MEETING   

Thursday, May 14, 2015                                      7:00 p.m.                                            Town Hall

The Board of Supervisor’s meeting was called to order at 7:00 p.m. 

Officials present:  Chairman Dan Knutzen, 1stSupervisor Dan Rettler, 2ndSupervisor Tom Neubert, Treasurer Jeri Ohman (left after Treasurer agenda items were discussed), and Clerk Karen Herman. 

Others present:  Resident Dan Ott was available to discuss his Certified Survey Map (CSM) (left at 7:09 p.m.) and Resident Michael Garvey was observing the Town Board meeting.
 

The agenda was posted according to the open meeting law on May 11, 2015. 

MOTION:  Rettler/Neubert to approve the April 13, 2015 Town Board Meeting Minutes.  All said aye.  Motion carried.  Minutes were not read.

MOTION:  Rettler/Neubert to approve the March 30, 2015 Planning Commission Meeting Minutes.  All said aye.  Motion carried.  Minutes were not read.

a.)  Sheriff Department– No one present.
      

b.) County Preliminary Reports or Certified Survey Map (CSM) approvals:  CSM—Ronald & Tammy Volkman
       010-068200
– Last month the Clerk contacted the surveyor (4/14/15) to let him know that the CSM was
       approved and to forward the originals to us for signatures but we haven’t received the paperwork as of
       today.
       Dan & Angela Ott 010-012100– In order to finance their home, the Ott’s need to split off their home from
       the rest of the parcel.  The split would be:  home 6.4462AC, and 33.5515AC.   Changing the boundaries
       in the future requires another CSM.  MOTION:  Rettler/Neubert to approve the CSM for Dan & Angela
       Ott.  All said aye.  Motion carried.  Dan Ott took the approved original CSM with him to give back to the
       surveyor.

C.)  Treasurer’s Report on receipts, disbursements, checking, and money market accounts for totals from the
       previous month

d.)  Budget Resolution 05-2015
       BUDGET ACCOUNT

       The sum of $5,000.00from the Fuel Surcharge/Land Fill Chargesbudgeted account betransferred to the
       budgeted category Attorney/Legalto pay the bills.
       The sum of $354.00from the Ambulance Runs/Ambulance Expbudgeted account betransferred to the
       budgeted category Attorney/Legalto pay the bills.
       The sum of $10.00from the Fuel Surcharge/Land Fill Chargesbudgeted account betransferred to the

e.)  Clerk Presents Bills and Transfers Money to Pay BillsMOTION:  Neubert/Rettler to accept the Treasurer’s
       report, approve the bills, and transfer $17,000.00 to pay the bills.  All said aye.  Motion carried.

f.)   Mike & Cindy Koller Division of Land to Build Home 010-029302Last fall the Koller’s contacted the
      Chairman to discuss the division of their land to build a home but did not get a response.  The Chairman
      will let them know the acreage requirements. 

g.)  2015-2016 Beer/Liquor/Operator Licensing – Romy’s Nitingale LLC—Agent:  Keith Romenesko; Operators:
       Dawn Balthazor, Allen Krause, Jessica Stoltz, Sandra Kohl, Dawn Moore, and Daniel DeBruin

       MOTION:  Neubert/Rettler to approve the 2015-2016 Liquor/Beer License for Romy’s Nitingale LLC; Agent
       Keith Romenesko; and operators Dawn Balthazor, Allen Krause, Jessica Stoltz, Sandra Kohl, Dawn Moore,
       and Daniel DeBruin.  All said aye.  Motion carried

h.)  Maple Crest Subdivision Discontinuance of Land for Lot 29 and Lot 30 Requested by Landowners Dan &
       Betsy Hermes
The Town Board wants to have the Public Hearing on 6/30/2015 at 7:00 p.m.  Certified
       letters are to be sent to Hermes (land owners), Denise Roskom, Elton Check, Fallen Timbers and to the
       North field landowner, and the West side landowners.  The Hearing fees were discussed.  The Chairman
       will be contacting the Hermes attorney to update him, including the meeting costs.  A Class-3 notice
       needs to be published in the ACN/Times Press (Seymour) newspaper. 

i.)  Town Hall –Board Room CabinetsTabled until the next board meeting.     

      Concrete Filled in at Front DoorRettler has filled in the concrete, job complete.  Take off agenda.
           

j.)  Roads–Status of Culvert on Krueger Rd in Front of Norman Steffen’s Home—Field Tile is Lower than the
      Culvert
– Getting estimates to determine the cost for this project.
 

      Cleaning Cross Rd Culvert South of Mike Bissing home on 12 Corners RdGetting estimates for repairs.
 

      Ballard/Culbertson Rd CulvertEstimate received last month $3,823, whole project approximately $4,000. 
      Tabled until the next board meeting.

      Culvert Fallen in – Schimmelpfenning Rd Off of County Rd PP by first homeTabled until the next board
      meeting.

      Ditch Repair on 12 Corners Rd from Accident – $750 for repairs– The Chairman reported that Brian
      Grendemann will be doing the work.  The Chairman did not bring the Sheriff’s Department accident
      receipt for billing purposes.

      Pot Holes on Town Roads– Brian Grundemann with E & G Restoration took care of patching the town pot
      holes. 

The Chairman presented bids from Scotts Construction.
MOTION:  Neubert/Rettler to take care of 3 roads.  Kropp Rd $30,775; Ott Rd Opt. #1 $2,250; and Forest Rd $8,496.  All said aye.  Motion carried.  Kropp Rd—CM Wedging on approx. (1,360ft.) full-width & (2,875 ft.) edges; Ott Rd – CM Wedging ONLY on two dipped edges on South side of road; Forest Rd (State Rd to Village Line) – 2,325 ft. x 22 ft. – full hot asphalt seal coat. 

Discussion took place regarding not receiving the yearly Crack Filling contract.     

      Purchase New Style of Road Sign Posts vs Old Style and 4 x 4 stop sign posts– It has been determined
      that the Town is not responsible for County or State Highway road name signs by the intersections of town
      roads.     

k.)  Planning Commission – Creation of Base Farm Tract MapNext Planning Commission meeting to update
       the joint Comprehensive Plan with the Village will be May 28, 2015 at 6:00 p.m. at the Black Creek Town
       Hall.

      Official Zoning Map needed according to approved Ordinance #01-2015Chairman informed the
      Board that he has contacted Dave Johnson and we will get the map in 2-week.  No maps received. 

 l.)  Permits Issued/Approvals/Violations (Building & Misc.) –Darrin Stingle – Culvert permit
     
MOTION:  Neubert/Rettler to approve Darrin Stingle’s culvert permit.  All said aye.  Motion carried.  

      New culvert permit for Wichman Farms Inc. (Mark and Bruce Wichman) for Field Entrance. 
      MOTION:  Rettler/Neubert to approve Wichman Farms Inc. culvert permit.  All said aye.  Motion carried.

m.)  FIRE/AMBULANCE – PAST DUE FIRE/RESCUE RUNS – Jason Vanderwegen $471.00; Cody Plaster $714.25;
       Chelsey Keller $797.50, Tyler Schulz $766.50
Clerk reviewed all run collection information.  Payment
       received from Vanderwegen $25.  Clarification was needed regarding Lisa Kehl’s outstanding run
       reviewed last month.  The run will remain pending as recommended by the Town’s Attorney.

       Town Ordinanceneeded for Fire Dept. to bill insurance companies for runsThe Chairman presented an
       ordinance which has been approved by the Black Creek Fire Dept. and Village of Black Creek.  The
       ordinance needs clarification and will be updated to reflect the changes which were discussed.

n.)   Ryan Rohan – Hwy 54 Recycling Compliance ResultsAttorney will be sending Rohan a letter.


o.)   Set Dates for Open Book and Board of Review—Adjourning BOR on 6/8/15 at 6:45 p.m. until an
       undetermined time. 
 

p.)   Annual Meeting 4/22/15 at 8:00 p.m.A motion was made at the Annual Meeting that all public
       hearings, special town meetings and annual meetings will now take place at 7:00 p.m. instead of
       8:00 p.m.
      

q.)   Pond Permit/Ordinance with Town Regulations– Discussion took place with revoking this ordinance since
        the county has stricter regulations.

 

r.)  Review and Adjust the 2015 Town of Black Creek Fee Schedule– Discussion took place.  Tabled until the
      next board meeting.

 

s.)   2015 Pavement Ratings are due to WisDOT by 12/15/2015—Knutzen will be contacting the County to
       complete the Towns Pavement Ratings.  The Clerk requested that we get an excel copy when it is
       complete.
