MONTHLY BOARD OF SUPERVISORS MEETING

The Board of Supervisor’s meeting was called to order at 7:05 p.m.
Officials present: Chairman Dan Knutzen, 1stSupervisor Dan Rettler, 2ndSupervisor Tom Neubert, Treasurer Jeri Ohman (left at 7:40 p.m.), and Clerk Karen Herman. Joey & Sara Tomazevic (left at 7:21 p.m.) were present to talk about land/building questions. Resident Mike Garvey was present to observe.
MOTION: Rettler/Neubert to dispense the reading and approve the 4/14/2016 monthly Town Board Meeting minutes as presented. All said aye. Motion carried.
MOTION: Rettler/Neubert to dispense the reading and approve the 4/25/2016 Special Board of Supervisor’s Meeting minutes as presented. All said aye. Motion carried.
The agenda was posted according to the open meeting law on May 5, 2016.
Building Permits:
#5 – Ronald Koehler – Garage with Electric
a.) Sheriff Department– No one present.
b.) Joey Tomazevic Parcel #010-004002 Would Like a Building Permit to Build a Home, Has a Driveway
Easement with No Road Frontage Over the Trail– Joey & Sara Tomazevic were present. There is
easement to this property but the driveway would be shared with the neighbor. An offer has been
placed for this property contingent with getting a building permit. The property is zoned general
agriculture. This will be put on the Planning Commission meeting agenda. Contact Joey with the
date/time of the next Planning Commission meeting.
c.) County Preliminary Consultation Checklist Reports or Certified Survey Map (CSM) Approvals: Lois
Volkman CSM Parcel #010-0784-00, 010-0781-00– Exclusive agriculture property rezoned to general
agriculture. This will be put on the Planning Commission meeting agenda. Knutzen will be contacting
Lois to give her an update with this situation.
Bruce & Karen Dietzen Preliminary Parcel #010-0566-01– This property is zoned exclusive agriculture.
Discussion took place. Knutzen will be checking into.
d.) Treasurer’s Report on Receipts, Disbursements, Checking, and Money Market Accounts for Totals from
the Previous Month– Payment received and deposited but not cleared the first time with our credit
union. Treasurer will be charging payer $20 fee.
e.) Budget Resolution #5-2016– Not needed this month.
f.) Clerk Presents Bills and Transfers Money to Pay Bills– MOTION: Neubert/Rettler to accept the
Treasurer’s Report, approve the bills, and to transfer $25,500.00 to pay the bills. All said aye. Motion
carried.
g) Licensing:
Romy’s Nitingale LLC–“Class B” Liquor and Class “B” Beer License;
Agent– Keith Romenesko; Operator Licenses–Dawn Balthazor, Melissa Niemuth, Allen Krause, Sandra
Kohl, Dawn Moore, and Daniel DeBruin– Tabled until the next board meeting.
Black Creek Sportsman’s Club, Inc.—Class “B” Beer License; Agent—Kyle Abel; Operator Licenses—
Thomas Brauer, Renee Miller, Jesse Beyer, and Thomas Bluma – Tabled until the next board meeting.
h.) May 19, 2016 Open Book 4pm – 6pm and Board of Review (BOR) 6pm – 8pm–Both notices were placed
in the ACN/Times Press, 3-posting places, website, and the front door of the town hall.
i.) Town Hall –RJM Construction Pavilion Plans/Storage Shed–Tabled until the next town board meeting.
j.) Roads–
Ballard/Culbertson Rd Culvert – Install New Culvert– Tabled until the next town board meeting.
Kropp Rd – Gravel on the Shoulder by the Road Curves– Tabled until the next town board meeting.
Crack Sealing Proposal– $10,000 yearly proposal. Crack sealing will work on the roads until the money
runs out. Road work will be done according to this order: (1)Kropp Rd, (2)Burdick Rd/12 Corners Rd,
(3)12 Corners Rd between Kluge Rd and Ott Rd, and (4)4 sections on Ott Rd. Map was provided showing
where the improvements will be done. Clerk is to verify this map with Crack Sealing.
MOTION: Kntuzen/Rettler to approve the $10,000 crack filling work on town roads. All said aye. Motion
carried.
Road Name Signs on State Rd– Eliminating the name ‘State Rd’ for the following dead end road name
signs: Black Friar/State and Kringle/State.
Radtke Proposal – Road Repair– Knutzen signed the $24,457.62 proposal for work to be completed on
Ballard Rd between Wood and Krueger Rd. Clerk is to return the signed proposal to Radtke.
Scott Construction – Chip Sealing Kropp Rd– MOTION: Knutzen/Rettler for Kropp Rd, State Rd and Stingle
Rd chip sealed. Radtke rebuilding of Ballard Rd between Wood & Krueger. Total $66,824.62. All said
aye. Motion carried.
Scott Construct Projects:
Kropp Rd – (from Wedging to East) – Single Seal coat $22,895.00
State Rd – (Brandt to Town Line) – Single Seal Coat $17,497.00
Stingle Rd – (Bridge area) – Full hot asphalt seal coat — $1,975.00
Krueger Rd – 200ft x 22ft – Seal Coat each side – Free of Charge
k.) Planning Commission – Creation of Base Farm Tract Map– Not discussed.
Official Zoning Map needed according to approved Ordinance #01-2015–Not discussed.
Draft Adoption Ordinance to Approve the Town and Village of Black Creek’s Updated Comprehensive
Plan– Tabled until the next town board meeting.
l.) Permits Issued/Approvals/Violations (Building & Misc.)–
Right of Way permit – We Energies WR#3921837– MOTION: Rettler/Neubert to approve the Right of Way
permit for We Energies. All said aye. Motion carried. Clerk will bill We Energies $50 for the permit fee.
Culvert Permit – Brad Steward – Wood Road– Culvert not completed yet.
Culvert Permit – Holly VanDeHei — Ballard Road– MOTION: Rettler/Neubert to approve Holly VanDeHei
culvert permit. All said aye. Motion carried. Clerk will send the approved permit to Holly.
MOTION: Neubert/Rettler to approve the Herman Brothers permits for tile and right of way. All said Aye.

New Building Permit — #5 – Ronald Koehler – Garage with Electric – Clerk will email a copy of this building
permit to our Town Building Inspector.
m.) FIRE/AMBULANCE – PAST DUE FIRE/RESCUE RUNS – Jason Vanderwegen $41.00–
Received payment for Vanderwegen account. Final Payment of $41 received. Take off agenda.

Town Ordinanceneeded for Fire Dept. to Bill Insurance Companies for Runs– Tabled until the next board
meeting.
New Equipment Fire Truck, Board of Commissioners of Public Lands (BCPL) Loan Application for a
Municipal General Obligation Loan $285,536 for 5-year term and Resolution to Approve this Loan–
Paperwork reviewed. MOTION: Neubert/Rettler to accept the loan of $285,536.00 for a 5-year term at
2.5% interest. All said aye. Motion carried. Contacting BCPL for further information with filling out the
paperwork.
MABAS Agreement– Knutzen will be contacting Ryan Schomisch to get a copy for town 2% fire dues
records.

n.) Ryan Rohan – Hwy 54 Recycling Compliance Results–Tabled until the next board meeting.
o.) Additonal Election Responsibilities for Clerk or Price Increase with the Outagamie County Provider
Agreement – Absentee Ballot Tracking and Voter Registration in WisVote–
The Clerk updated the Board with the Memo of Understanding (MOU) Relier/Provider election
agreement with Outagamie County. 2015 Act 261 (2015 Senate Bill 295) published on 3/17/16 requires
clerks to input the required absentee voting information into the official registration list within a specified
period of time. This function is not included with our current MOU agreement with Outagamie County.
Thank you Outagamie County with entering this information for municipalities during the April 2016
election. The August 2016 election (actually 6/23 when absentee ballots are first sent out), all Clerks are
responsible to enter absentee tracking services and voter registrations, received prior to the elections, in
the WisVote system 48 hours from when it occurs. It was my understanding that the County Finance
Committee was possibly willing to help the municipalities out with this through the 2016 election year, for
the smaller municipalities. We now have a new County Finance Committee Board since the past
election and I do not know what direction they will take with this issue. We were hoping that the
County could help us out through this Presidential year and to tackle this function and training next
year. Meeting at the Town of Grand Chute tomorrow from 10 a.m. – Noon to review the new required
process. Meeting with the County Finance Committee at 4 p.m. tomorrow.
p.) Approve the Outagamie County Recycling & Solid Waste Grant Opportunity with Purchasing Recycling
Carts– Knutzen will be contacting Harters to find out how carts would be handled with our current
contract.
Correspondence taken care of.
Clerk mail:
–Yearly notice from Outagamie County Planning and Zoning Depts. regarding the Preservation of all PLSS
Monuments and Records in Outagamie County.
–Received a letter from Local Government Property Insurance Fund that our old policy has been cancelled.
–Forwarded letter from the WI Dept. of Safety and Professional Services to Black Creek Fire Dept. Ryan
Schomisch, regarding the building of an Alternative School on Robin Rd.
–Nationwide adding/removing funds to our plan.
