Planning Commission Meeting Minutes


Wednesday, February 8, 2012                           7:00 p.m.                                                 Town Hall

The Planning Commission Meeting was called to order at 7:00 p.m.
 
Planning Commission members present:  Merlin Heiden, John Lemke, Norman Steffens, Bill West, and Dan Knutzen (Chairman).  Clerk Karen Herman was also present.
 
The agenda was posted according to the open meeting law February 3, 2012 at the 3-posting places.

MOTION:  Heiden/West to accept the planning commission minutes from the January 25, 2012 meeting.  All said aye.  Motion carried.


a.  Review updated zoning ordinance/approval–  
      Pre-DATCP submittal Zoning Ordinance not received from Jeff Sanders as of today.

b.  Dennis & Nancy Vande Walle property – Consider zoning change to exclusive
     agriculture for parcel numbers 010-0305-00 (40 acres) and 010-0306-00 (38.39 acres)
     currently zoned residential

    
Letter received from Dennis & Nancy Vande Walle today requesting consideration for their two parcels to
      be zoned exclusive agriculture.

Recommendation Motion to the Town Board:  Lemke/West Change Dennis & Nancy Vande Walle’s parcels back to Exclusive Agriculture for parcels 010-0305-00 (40 acres) and 010-0306-00 (38.39 acres).  All said aye.  Motion carried.

c.  Michael & Brenda Garvey property – consider zoning change to general agriculture
    for Parcel number 010-0263-00 (38.03 acres) currently zoned exclusive agriculture

    Recommendation Motion to the Town Board:  Knutzen/Lemke to leave current zoning as is for the Garvey’s
     parcel #010-0263-00 (exclusive agriculture).  All said aye.  Motion carried.

d.  Update zoning map/approval– Updates were completed on the town’s zoning map by Bill West and
      Dan Knutzen before the meeting began tonight.  The map identifies the 2 parcels being rezoned from
      single family residential to exclusive agriculture:  010-0305-00 and 010-0306-00.
      The 7 parcels being rezoned from Exclusive Agriculture to General Agriculture are:  010-0454-00,
      010-0454-01, 010-0578-02, 010-0286-00, 010-0205-01, 010-0216-01, 010-0235-00, and 010-0235-02.

      David Kuhn (parcel #010-0205-00) at N6560 County Rd PP (land previously approved for a rezone to
      general agriculture) wants to remain in Exclusive Agriculture Zoning.  He has discussed this with
      Dan Rettler (1st Supervisor with the Town Board) and also Dan Knutzen.  He was telephoned during the
      meeting requesting that he send a letter to the Town Board indicating that he would now like his property
      to remain in exclusive agriculture zoning.

Planning Commission signed the recommendations to the Town Board which were updated tonight and are listed below:
            The Planning Commission is recommending to the Town Board of Black Creek that anything under 10 acres would be considered for rezoning.  Special conditions which could result in consideration for a rezone out of exclusive agriculture of parcels greater than 10 acres in size might include the presence of wetlands, woodlands, and other non-farm uses.

This process is apart of the Zoning Ordinance re-write.

                        Marginal requests needing more information or why not suited as exclusive ag:

                        No Rezones

                        Requesting no changes to current zoning status:
                        David Kuhn—parcel no. 010-0205-00—letter is in the process of being sent
                        to the town requesting that no zoning changes take place with this parcel
                        which will change his original request letter. 

                        The Planning Commission is also recommending to the Town Board to send a
                        letter to all requesters with the decision for their property.  The “No Rezones
                        and Marginal requests needing more information or not suited as exclusive ag
                        can resubmit their requests.  A situation where the Planning Commission would 
                        reconsider their request is if the acreage has a special use such as wetlands,
                        woodlands or other non-farm uses.

      Motion – West/Lemke to adjourn at 8:36 p.m.  All said aye.  Motion carried.
