BOARD OF SUPERVISORS MEETING
Thursday, May 16, 2013 7:00 p.m. Town Hall
The May 2013 Board of Supervisor’s meeting was called to order at 7:10 p.m. immediately after the audit hearing.
Officials present: Chairman Dan Knutzen, 1st Supervisor Dan Rettler, 2nd Supervisor Tom Neubert,
Clerk Karen Herman, and Treasurer Jeri Ohman. Scott Holz was present to discuss his Certified Survey Map (CSM).
The agenda was posted according to the open meeting law on May 13, 2013.
MOTION: Rettler/Neubert to dispense the reading of the minutes and approve the April 8, 2013 monthly TOWN BOARD MEETING minutes as presented. All said aye. Motion carried.
Building Permits: None
a.) Sheriff Department– No one present.
b.) (ATC) American Transmission Company—Transmission Line Project–
Knutzen reported that the line project is not coming into the Town of Black Creek. Take off agenda.
c.) Town Hall – Town Hall – Knox Box Fire Security System – The Fire Department will have access to an
outdoor key Knox Box system to enter the town hall for only emergency situations.
MOTION: Rettler/Neubert to get a Knox Box for the Town Hall. All said aye. Motion carried.
Rettler and Neubert will be taking care of getting this installed. Take off agenda.
d.) Roads –
Resident requesting speed limit sign 15 mph on Robin Rd-Ordinance to lower speed limit –
35 mph signs have been posted on Robin Rd on 5/3/2013 at the entrance level and by Fallen Timbers.
Knutzen reported that State Rd by Wick Rd the ditch has been cleaned out.
Genske Rd bump in road has been cleaned up.
Weight Limits taken off town roads – Completed 5/4/2013. Take off agenda.
Schwind Trucking Disposal permits (3) sludge from the Village of Black Creek WWTP: Robert
Schmidt, Tom Beyer, Darrin Stingle properties– MOTION: Neubert/Rettler to approve the sludge
permits for hauling from the Village of Black Creek. All said aye. Motion carried. $300 check given to
town treasurer for deposit.
Pavement Ratings due 12/2013– Knutzen wants to have Outagamie County take care of the
pavement ratings this year. Tabled until the next board meeting.
**Scott’s Construction meeting to look at the town roads – Clerk will be notified when this will occur.
e.) Setup hearing dates –Freedom Development – Outstanding issues: Comprehensive Plan
Amendment needed before County Board can give final approval (hearing date was 1/31/2007) &
Clayman Creek Storage zoning changes on map; Town Official Map Approval/Working Lands
Requirements/Land Division-Subdivision Ord. // Response to rezone requests–
No update to status given.
f.) Ordinance/Permit Violations—Kropp Rd ditch filled in by resident Duane Felton – This is an ongoing
situation. Take off agenda.
g.) Permits Issued/Approvals (Building & Miscellaneous) // Culvert Permit Rate Change –
–Received a copy from Outagamie County Erosion Control & Storm Water Management Permit for
Steve Van Camp.
–Road right of way permit received from WE Energies to install underground electrical service for Dale
Schmoll’s new home on Kropp Rd. MOTION: Neubert/Rettler to approve the WE Energies permit for
electrical box installation on Kropp Rd. All said aye. Motion carried. (2 original permits received,
send one back and bill WE Engeries for permit)
–New Permit received for Robert Schumacher for a field driveway on Calnin Rd – keep until approved.
–MOTION: Knutzen/Rettler to change the Culvert Permit rate from $25 to $40 effective 7/1/2013 with a
notice posted at the 3-posting places. All said aye. Motion carried.

j.) Budget Resolution 2-2013—Not needed this month.
k.) April 2, 2013 General Election – New 2-year terms: Chairperson Dan Knutzen; 1st Supervisor Dan
Rettler; 2nd Supervisor Tom Neubert, Clerk Karen Herman, Treasurer Jeri Ohman, and Constable Erik
Heiden. Wall picture of Erik Heiden will be needed for the town official picture display.
l.) Free Tire Recycling/Scrap Metal Day Date: Spring 4/13/2013–
Dan Rettler reported that there was a good turn out. Bill received from Reetz Recycling today for
two dumpsters for tires ($300) and one for scrap metal ($100).
m.) RefinanceFire Hall Building Loan (joint with Village) – MOTION: Neubert/Rettler to accept the 3-year
loan with BMO Harris for the fire hall loan joint with the Village of Black Creek. All said aye. Motion
carried. This loan is written in the Town of Black Creek’s name. The Village will pay the Town ½ of the
payment due. Clerk will forward copies of documents to the Village of Black Creek.
n.) BOR Appeal to Wis. Supreme Court – Frank Sausen – Lawyer has contacted Knutzen that this case has
been appealed to the Supreme Court of Wisconsin. The Town has won the first two cases.
o.) Certified Survey Map (CSM) approvals: Outagamie County CSM 010-0666-00; Scott Holz CSM 010-
0552-00 – Board signed the CSM Permit for Scott Holz. MOTION: Neubert/Rettler to accept the CSM for
Scott Holz and when the official document arrives, the board will sign the CSM at that time. All said
aye. Motion carried.
MOTION: Neubert/Rettler to approve the CSM division of Outagamie County town land. All said aye.
Motion carried.
The Outagamie County Preliminary CSM report was review for the Buman property on Twelve Corners
Rd. Board saw no issues with the division of land.
p.) Reserve Liquor License $10,000 payback fee application – Knutzen will be getting a sample
application. MOTION: Rettler/Neubert to give $10,000 back when receipts are presented to show the
work done to improve the building. All said aye. Motion carried. This is for a Reserve Liquor License.
q.) Polling Place Accessibility Compliance Audit Report – response of action due 3/27/13 –
A letter was presented to the town board stating that the action plan has been approved by the GAB
(Government Accountability Board). Board talked about pouring concrete slurry to create slight slope
to raise existing concrete by 1”.
r.) 2013 Licensing: Black Creek Sportsman’s Club, Inc. – Kyle Abel, Tom Bluma, Tom Brauer, Kyle
Holtz, Ed Miller, Christopher Moeller; Romy’s Nitingale LLC – Dawn Balthazor, Daniel DeBruin, Sandy
