MONTHLY BOARD OF SUPERVISORS MEETING

The Board of Supervisor’s meeting was called to order at 7:00 p.m.
Officials present: Chairman Dan Knutzen, 1st Supervisor Dan Rettler, 2nd Supervisor Tom Neubert, Treasurer
Jeri Ohman (left after the Treasurer’s agenda items were completed), and Clerk Karen Herman.
The following people were present:
Jim Hebert with Hebert Land Surveying Associates, Inc.; (left the meeting at 7:10 p.m.);
Ryan & Amanda Rohan, Recycling Compliance (left at 7:32 p.m.);
Attorney Bob Duimstra, Menn Law Firm, representing the Rohan’s (left at 7:32 p.m.);
John Hasha, Pete Ross, Seymour School District Administrator and Tim Diermeir, representing Seymour School District (left at 8:00 p.m.);
Deputy Sheriff Sheldon Pedranzar (left the meeting at 7:37 p.m.); and
Resident Mike Garvey (left the meeting at 8:05 p.m.).
The agenda was posted according to the open meeting law on March 12, 2016.
MOTION: Neubert/Rettler to dispense the reading of the monthly Town Board Meeting Minutes for
February 18, 2016 and approve the minutes. All said aye. Motion carried.

AGENDA ITEMS TAKEN OUT OF SEQUENCE
C.) Black Creek Prop. LTD (VanHandel) CSM Parcel #010-067700 – It is noted on the CSM the following:
7. Access is to Lot 2 over the existing driveway is granted to the Town of Black Creek
8. The owners will provide an access easement to Lot 1 or Lot 2 in the event of the sale of Lot 1 or Lot 2.
MOTION: Rettler/Neubert to approve the VanHandel CSM (Joan VanHandel). All said aye. Motion
carried.
n.) Ryan Rohan – Hwy 54 Recycling Compliance Results – Ryan & Amanda Rohan and their Attorney Bob
Duimstra with Menn Law Firm, were present to discuss the Recycling Compliance issue. Letter dated
7/9/2015 from the DNR addressed to Rohan, Subject: WPDES Storm Water No Exposure Certification
Compliance, was presented to the Board. The Town’s Attorney and Attorney Bob Duimstra will be
contacting one another to discuss this situation. Tabled until the next Town Board meeting or until the
lawyers discuss this situation further.
a.) Sheriff Department– Deputy Sheriff Sheldon Pedranzar was present to discuss town issues. There have
been burglaries in the County, remember to lock up your buildings.
–Pete Ross, John Hasha, and Tim Diermeir were representing the Seymour Community School District to discuss the Alternative High School being built by Fallen Timbers. This project is in the process of being approved. The school will look like a house. As time goes on, more information will be released regarding this project. The Alternative School will be on the School Boards 4/26/2016 agenda for approval. Construction starting in May and finished in August. Someone representing the Seymour School District will be available for our Annual Meeting.
b.) Paul Kaphingst Property Parcel #010-018200—Drainage of Woods – This issue is being resolved without the
town. Take off the agenda.
c.) County Preliminary Reports or Certified Survey Map (CSM) Approvals: Lois Volkman CSM
Parcel #010-0784-00, 010-0894-02, 010-0781-00 – Lois will be providing the town a revised CSM showing
no flagged lots.

Nick & Linda Vandevoort Property Split and Rezone for Parcel #010-0289-00 –Ariel map reviewed.
Knutzen verified with the County that when a parcel of land is split by a road, a CSM is not required. He
can apply for a rezone and land division with this parcel.
d.) Treasurer’s Report on Receipts, Disbursements, Checking, and Money Market Accounts for Totals from
the Previous Month –
–New fire truck for the Town and Village of Black Creek will cost $80,000. Town and Village of Black Creek will each pay $20,000 for a down payment. Put on next month’s agenda $20,000 down payment to Truck Country. Truck possibly done in August 2016. Setting up loan by June 2016.
e.) Budget Resolution #4-2016 – Not needed this month.
f.) Clerk Presents Bills and Transfers Money to Pay Bills– MOTION: Rettler/Neubert to accept the
Treasurer’s Report, approve the bills, and to transfer $35,000.00 to pay the bills. All said aye. Motion
carried.
g) Create Razing Permit – MOTION: Neubert/Rettler to accept the razing permit to be implement 6/1/2016.
Clerk will find out the notice requirements.
h.) 2016 Free Tire Recycling and Scrap Metal Collection April 16 and September 17 –All set for collection.
i.) Town Hall – Board Room Cabinets – Cabinets have been purchased. Take off agenda.
RJM Construction Pavilion Plan –Tabled until the next meeting.
Skinkis Lawn & Landscape LLC – Town Hall http://nygoodhealth.com Maintenance Agreement – The cost will be $85.00 for each
mowing and $3.50 for plant maintenance. MOTION: Neubert/Rettler to accept Dave Skinkis with mowing
the Town Hall. All said aye. Motion carried. Agreement was signed. Clerk will send one signed
agreement back to Skinkis.
j.) Roads–
Ballard/Culbertson Rd Culvert – Install New Culvert – Wood/Ballard Rd patch now but 1/10th of mile
reconstruct in the future.
–Brian Grundemann repaired the roads by bridges.
Kropp Rd – Gravel on the Shoulder by the Road Curves – Will gravel curve when drier out.
–Ditches will be cleaned, as seen fit, on Wick, Forest, State, Mullen, Stingle, and Schimmelpfenning Road.
MOTION: Rettler/Neubert for Gruendemann to clean out ditches. All said aye. Motion carried.
Stingle Rd and East side of Highway 47.
–Knutzen contacting County to bill the Town $100 for an erosion control permit from Tim Roach.
Timber Creek – Tree Removal at W4820 Krueger Rd, Adolf Rd, and Wolf Rd – Work done, take off agenda.
Weight Limits on Roads – Weight limits were placed on the Town roads.
Outagamie County Refunding Payment for Engine Breaking Sign – Clerk contacted the County Highway
Dept. and the bill was for the Village of Black Creek. County will reimburse the Town. Clerk informed our
Treasurer.
k.) Planning Commission – Creation of Base Farm Tract Map –
Official Zoning Map needed according to approved Ordinance #01-2015 –
Future Comprehensive Plan Meetings/Public Hearing Date; Approve Application Forms for Zoning
Ordinance – Tabled until the next meeting
l.) Permits Issued/Approvals/Violations (Building & Misc.) –
–Wisc. Technology Networking, LLC – Right of Way Utilization Application, Transport Utility Pole–
Mapping reviewed. Pole will be placed in the ditch. Knutzen will contact Wisc. Technology Networking,
LLC to find out what this about before sending anything back or billing them $50.
Update the Road Right of Way Permit fee of $50 on the application form to match our Fee Schedule.
m.) FIRE/AMBULANCE – PAST DUE FIRE/RESCUE RUNS – Jason Vanderwegen $181.00; Chelsey Keller $797.50;
Ann Marks $749.25 –Payment for Vanderwegen received $40 today.
Ann Marks — Reviewed Attorney response with the collection process. Judgement docketed. Remove
from the agenda. MOTION: Neubert/Rettler–Ann Marks judgement has been docketed. Take off
agenda. All said aye. Motion carried.
David VerVoort $200.00; Stephanie Manka $200.00; Peter Keberlein – Town Attorney is waiting for a
response from the Town Board in regards to the next step with the collection process.
Town Ordinanceneeded for Fire Dept. to Bill Insurance Companies for Runs – Tabled until the next board
meeting.
–MABAS Agreement – Dan Rettler will get a copy of the agreement for the Town’s 2% fire dues records.

o.) Research New Property Insurance for BC Fire Building and Town Hall — Waiting to receive the final
insurance quotes. Tabled until the next board meeting.
p.) 2% Fire Dues Self Certification — Town Board Approving/Verifying that the Certification List is Complete
which the Clerk Approves Online – The Town Board signed the Clerk’s form verifying that she received
all the possible paperwork associated for the self-certification approval process.
q.) April 5, 2016 Presidential Preference and Nonpartisan Election/Election Workers/Renting 1 Edge Machine
for the November 8 General Election/ Approve New Chief Inspector/Additional Election Responsibilities
for Clerk – MOTION: Neubert/Rettler to contact Command Central to reserve for the November
Election to rent an Edge machine. All said aye. Motion carried.
Clerk can appoint an additional Chief Inspector and get them the certified training.
The Relier/Provider contract with the Outagamie County Clerk’s office may need to be rescinded. Due to recent law changes, the County will not be able to keep up with the absentee WISVOTE online tracking process. When an absentee request is make, absentee ballot sent/voted in office, and absentee ballot received back to the Clerk, each step must be tracked within 24 hours in the WISVOTE system. The County does not have the capacity to add this responsibility for 19 WisVote relier municipalities.
r.) Housing Report – Reviewed the 2015 housing report.
s.) Annual Meeting Food and Drink – Rettler will be purchasing the drink and our local 4H group will be
providing the food.
Correspondence taken care of.
Total bills for March 2016: Fox Communities Credit Union = $35,492.72
List of March bills are attached.
