MONTHLY BOARD OF SUPERVISORS MEETING

June 13, 2016
    

Monday, June 13, 2016                                           7:00 p.m.                                                 Town Hall
The Board of Supervisor’s meeting was called to order at 7:00 p.m.  

Officials present:  Chairman Dan Knutzen, 1stSupervisor Dan Rettler, 2ndSupervisor Tom Neubert, and Clerk Karen Herman.  Treasurer Jeri Ohman was absent.  The following people attended the meeting:  Andy Gayhart with Harter’s Fox Valley Disposal (left at 7:47 p.m.); Resident Mike Garvey; Joe Ryba (left at 7:21 p.m.); and Deputy Sheriff Brozewski (left at 7:13 p.m.) 

MOTION:  Rettler/Neubert to dispense the reading and accept the 5/9/2016 monthly Town Board Meeting minutes as presented.  All said aye.  Motion carried.   

MOTION:  Rettler/Neubert to dispense the reading and accept the 5/9/2016 Audit Hearing minutes as presented.  All said aye.  Motion carried.  

MOTION:  Neubert/Rettler to dispense the reading and approve the 5/19/2016 Special Board Meeting minutes as presented.  All said aye.  Motion carried.  

MOTION:  Neubert/Rettler to dispense the reading and accept the 5/19/2016 Board of Review Meeting minutes as presented.  All said aye.  Motion carried.

a.)  Sheriff Department– Deputy Sheriff Brozewski was present to discuss town issues.

**Joe Ryba – Discussed building requirements for exclusive and general agriculture zoning.

p.)   Approve the Outagamie County Recycling & Solid Waste Grant Opportunity with Purchasing Recycling
       Carts, Resolution #07-2016/Harter’s Policies and Agreements
Andy Gayhart with Harter’s Fox Valley
       Disposal was available to discuss the possibility of purchasing or renting garbage and recycling carts.  It
       will take approximately 1 month to receive the carts so Harter’s will need 1 ½ months of lead way if
       purchasing or renting carts through Harter’s.  Our current contract with Harter’s expires December 31,
       2017.  The cost goes down when using carts even if we buy carts or if the hauler supplies carts. 
       Maintenance of carts was discussed.
 
       The Town Board decided to pass with the County grant proposition with purchasing recycling carts and
       to review the cart process with our new garbage and recycling contract next year.

b.)  Joey Tomazevic Parcel #010-004002 Would Like a Building Permit to Build a Home, Has a Driveway
       Easement with No Road Frontage Over the Trail

       Commission meeting.

c.) County Preliminary Consultation Checklist Reports or Certified Survey Map (CSM) Approvals:  Lois
       Volkman CSM Parcel #010-0784-00, 010-0781-00

       Ralph & Shirley Beyer CSM Parcel #010-0578-00 (Tim Beyer)– This agenda item will be discussed at the

d.)  Treasurer’s Report on Receipts, Disbursements, Checking, and Money Market Accounts for Totals from
       the Previous Month
Treasurer’s report was reviewed.

e.)  Budget Resolution #6-2016Not needed this month. 

f.)   Clerk Presents Bills and Transfers Money to Pay BillsMOTION:  Rettler/Neubert to approve the
       Treasurer’s Report, approve the bills, and to transfer $76,000.00 to pay the bills.  All said aye.  Motion
       carried

g)   Licensing: 
       Romy’s Nitingale LLC–“Class B” Liquor and Class “B” Beer License;
       Agent– Keith Romenesko; Operator Licenses–Dawn Balthazor, Melissa Niemuth, Allen Krause, Sandra
       Kohl, Dawn Moore, and Daniel DeBruin

       MOTION:  Neubert/Rettler to approve the “Class B” Liquor and Class “B” Beer License, Agent Keith
       Romenesko, and the Operator Licenses for Dawn Balthazor, Melissa Niemuth, Allen Krause, Sandra Kohl,
       Dawn Moore, and Daniel DeBruin.  All said aye.  Motion carried.
       Black Creek Sportsman’s Club, Inc.—Class “B” Beer License; Agent—Kyle Abel; Operator Licenses—
       Thomas Brauer, Renee Miller, Jesse Beyer, and Thomas Bluma

       MOTION:  Rettler/Neubert to approve the Class “B” Beer License, Agent Kyle Abel, and Operator
       Licenses for Thomas Brauer, Renee Miller, Jesse Beyer, and Thomas Bluma

h.)  Review Bridge Inspections ReportDiscussion took place regarding the following bridges which the Town
       Board will be looking into: 
       –State Rd – S/E Sign ‘Bridge Caution’, guard rail, and wedge both approaches;
       –Stingle Rd (Duck Creek) – vegetation by signs;
       –Krueger Rd (Duck Creek) – Vegetation, utility signage markers are low.

 i.)  Town Hall –RJM Construction Pavilion Plans/Storage ShedTabled until the next Town Board meeting.     

j.)   Roads–
      Ballard/Culbertson Rd Culvert – Install New Culvert
Tabled until the next Town Board meeting.

      Kropp Rd – Gravel on the Shoulder by the Road Curves– Brian Gruendemann took care of.  Take off
      agenda.
      Crack Sealing Proposal– Tabled until the next town board meeting.
      Road Name Signs on State Rd– Signs ordered.  Tabled until the next Town Board meeting.
      Radtke Proposal – Road Repair– Complete.  Take off agenda.  Extra necessary work was done to
      complete the road repair.
      Scott Construction – Chip Sealing Kropp Rd– Tabled until the next Town Board meeting.     

k.)  Planning Commission – Creation of Base Farm Tract MapTabled until the next Board meeting.

      Official Zoning Map needed according to approved Ordinance #01-2015Not discussed.

      Draft Adoption Ordinance to Approve the Town and Village of Black Creek’s Updated Comprehensive
      Plan
– Planning Commission will be meeting on 6/23 with anticipation that recommendations will be
      make for Town Board approval.


l.)   Permits Issued/Approvals/Violations (Building & Misc.)

      Right of Way permit – Joshua Schafer – Ballard RdMOTION:  Rettler/Neubert to approve Joshua
      Schafer’s driveway extension.  All said aye.  Motion carried.   
      Culvert Permit – Brad Steward – Wood RoadMOTION:  Neubert/Rettler to approve Brad Steward’s
      culvert permit.  All said aye.  Motion carried.
      Culvert Permit – Holly VanDeHei — Ballard Road– Clerk needs address to return the approved permit to
      Holly.  Rettler will hand delivering her approved permit.
      Sludge Permit – Waldvogel Trucking – Property Owners Jeff & Dori Waldvogel and Bob and Dave Dorn –
      Payment Received
– Send the permit and payment back to Waldvogel Trucking.  No permit is required
      by the Town.  DRN regulates.  No need to request a permit from the Town.

      –Eliminate Sludge Permit Ordinance – put on next month’s agenda.
      –New Culvert Permit for Harlan Volkman.  MOTION:  Neubert/Rettler to approve the culvert permit for
         Harlan Volkman, Ballard Rd.  All said aye.  Motion carried.

        David VerVoort $200.00– Received $200.00 payment from Town Attorney.
        Stephanie Manka $200.00; Peter Keberlein–Nothing new to report.
        William Buelow $200.00 – BC Rescue Received Payment– Payment of $200 originally sent to Black Creek
        Rescue and signed over to the Town of Black Creek. 
        Jamie Nerious $200– Nothing new to report.

        Town Ordinanceneeded for Fire Dept. to Bill Insurance Companies for RunsTabled until the next board
        meeting. 
        New Equipment Fire Truck, Board of Commissioners of Public Lands (BCPL) Loan Application ‘Approved’
        for a Municipal General Obligation Loan $285,536 for 5-year term/Complete the ‘Request for Loan
        Disbursement’ Form
– Clarification of paperwork is needed.  Contacting BCPL for explanation.  Two
        draws will be taken from the loan.

       –Billing for 6 Ambulance Runs Received and payment make to Black Creek Rescue for $2,198.00—Nash
          Fisk $200; Colton Gaertig $200; Mark Johnson $200; 3 runs for Randa Richley $606, $436, $556.  Clerk will
          forward the billing to our Town Attorney for collection process.

          MABAS Agreement– Clerk is to contact the Outagamie County Emergency Management group and
          ask for a copy of the agreement.
 

n.)  Ryan Rohan – Hwy 54 Recycling Compliance ResultsTabled until the next board meeting.
 

o.)   Additional Election Responsibilities for Clerk or Price Increase with the Outagamie County Provider
        Agreement (UPDATE) Absentee Ballot Tracking and Voter Registration in WisVote/Approve an
        Amendment to the current Memo of Understanding (MOU) Agreement with Outagamie County to
        Include Absentee Tracking/Voter Registration
        MOTION:  Neubert/Rettler to approve the MOU with Outagamie County WisVote.  All said aye.  Motion
        carried.  MOU Agreement was signed and the Clerk will return one copy to the County via email.

s.)  Order New LaptopClerk will be contacting PCI Data Systems to get a quote for a new laptop.  The old
      laptop can be used for elections.  Clerk will also be checking into other resources for internet services.
